Summary
San Luis Obispo County requires every single-family home on franchised trash service to separate recyclables from garbage and use the franchisee's curbside recycling bin. The County backs this with a garbage-sampling enforcement program under County Code Section 8.98.020.
(a)All occupants of a single-family residential facility which receives solid waste collection service from a franchisee shall separate recyclable materials from garbage going to the landfill for disposal. The recyclable materials shall be placed in the curbside recycling containers provided by the franchisee or recycled by any other legal means that the occupant decides to utilize. ... (d)In the event that the county becomes aware that available recycling services are not being utilized, the county may conduct sampling of the garbage in the garbage container to assure substantial compliance with the recycling requirements of this section. If the garbage sample contains more than twenty percent of recyclable materials as defined in the franchise agreement, the facility will be deemed to be in substantial noncompliance. A written warning to comply with this chapter may be issued to the responsible person and/or occupant and the waste may be sampled again within a six-month period to assure compliance with this chapter.
Full Breakdown
020(a) puts the separation duty on the occupant: recyclable materials must go in the curbside recycling container the franchisee supplies, or be recycled by any other legal means the occupant chooses. 030, which makes the responsible person supply on-site recycling service and give occupants annual, move-in, and service-change notices about what is accepted and where the bins sit. Enforcement runs through garbage sampling under subsection (d): if the County becomes aware curbside recycling is not being used, it can sample a household's garbage container. A sample containing more than twenty percent recyclable material, as defined in the franchise agreement, is deemed substantial noncompliance.
060. 050 preserves the right to self-haul recyclables to a facility instead of using the franchisee, so long as recyclable items are still pulled out before landfill disposal.
Violations & Fines
A garbage sample testing above twenty percent recyclables is substantial noncompliance. The first finding gets only a written warning and a re-sample window of up to six months; a second substantial-noncompliance finding for the same responsible person or occupant triggers liability under Chapter 8.98's penalty provisions, which run through the County's Chapter 1.05 administrative fine process rather than criminal court.
