Des Moines Chapter 42, Article X requires a tree removal and mitigation plan before obtaining grading permits, site plans, or subdivision approvals. Mature trees must be preserved or replaced at a ratio of one replacement tree per 2,000 square feet of removed canopy area.
Chapter 42, Article X (Β§Β§ 42-550β42-556), enacted by Ordinance No. 14,889, requires a tree removal and mitigation plan for any grading permit, site plan, or subdivision plat. Des Moines uses 'mature tree' and 'canopied area' rather than 'heritage tree.' Mature trees and canopy identified for preservation must be protected during construction. Under Mitigation Option A, one replacement tree is required per 2,000 square feet of canopy removed since May 1, 2009. Replacement trees must be selected from the city council-approved species list. The Zoning Enforcement Officer administers Article X as part of the permitting process.
Unpermitted removal of protected trees or failure to comply with a mitigation plan can result in stop-work orders, mandatory replanting or mitigation payments, and civil penalties under Ch. 42 and Β§ 1-15 of the municipal code.
