SMC §12.09.020 defines a heritage tree as a tree or group of trees officially designated by the Parks and Recreation Commission that (a) has historical significance or aura of historical appeal, (b) consists of trees mutually dependent for survival, (c) is an outstanding specimen of its species (healthy, mature, well formed), or (d) measures 50 inches or more in diameter at 24 inches above natural grade. Designation also requires recommendation by the Parks and Recreation Commission and acceptance by the City Council (§12.09.020). Chapter 12.09 prohibits removal and damage to heritage trees, with penalty provisions in §12.09.060 and designated historical trees treated under §12.09.050.
Damaging or removing a designated heritage tree is enforced under SMC §12.09.060 (Penalties). General municipal code violations in Sonoma can be prosecuted as misdemeanors (up to $1,000 fine and/or jail) or as infractions, plus mandatory replacement under §12.08.065.
