Parma Codified Ordinance 911.03 requires a permit issued by the Director of Public Service before any person may plant, prune, or remove any tree on public property, including tree lawns. Section 911.12 governs preservation and removal of public trees by the City.
Under Parma 911.03, no person other than authorized City employees or contractors may plant, set out, prune, or remove any tree on any public property, public right-of-way, or tree lawn without first obtaining a permit from the Director of Public Service. Section 911.12 authorizes the City to preserve, trim, or remove diseased, damaged, or hazardous trees on public property. Section 1707.11 requires the Director of Public Service to keep public-place trees trimmed so that branches are at least nine feet above sidewalks and driveways and clear of the curb line. Removal of trees on purely private property is not regulated by Parma's code β it is governed by ordinary property rights.
Removing or damaging a public tree without a permit is a violation of Chapter 911 and is prosecuted under the Parma general code-penalty section 698.02 β minor misdemeanor first offense, M4 for willful violation (up to $250 / 30 days). Civil restitution for the value of the destroyed public tree may also be sought.
