Summary
Lake County's rural conservation subdivision rules let developers add up to a 25% increase over the density their zoning district would otherwise allow. LDR § 17.05.00 lets the Board of County Commissioners grant the increase when a project sets aside extra protected open space beyond the minimum, or dedicates land for public trails, recreation, or spray irrigation fields.
17.05.01 Generally. The maximum number of building lots or dwelling units in a subdivision shall not exceed the number that could otherwise be developed by the application of the minimum lot size requirement and/or density standard of the zoning district or districts in which the parcel is located. However, increases in the number of building lots or dwelling units are permitted at the discretion of the Board of County Commissioners when it determines that the applicant has met one of the bonus criteria. Such discretionary bonuses are permitted through one or more of the options in this subsection, and shall not exceed, in total, more than a twenty-five (25) percent increase in density. ... 17.05.03 To Encourage Public Access. Dedication of land for public use (including trails, active recreation, municipal spray irrigation fields, etc.), in addition to any public land dedication authorized under Florida law, may be eligible for a density bonus. ... shall be computed based on two (2) dwelling units for every acre of publicly accessible land.

Full Breakdown
01 sets the baseline: a subdivision's building lots or dwelling units cannot exceed what the minimum lot size requirement or density standard of its zoning district allows, unless the Board of County Commissioners grants a discretionary bonus. Any combination of the bonus options in this subsection cannot push the total increase above 25% of density. 02 covers the open-space path: for each additional acre of protected, unconstrained buildable open space beyond what's already required, the applicant earns two additional building lots or dwelling units. Instead of adding that open space on-site, an applicant may purchase separate unconstrained land in fee simple or in less-than-fee (such as development rights), dedicating fee-simple purchases to a unit of local government, the State of Florida, or a private nonprofit land conservancy; a less-than-fee purchase instead requires a recorded conservation easement restricting the land's development potential, dedicated the same way.
03 covers the public-access path: dedicating land for public use, including trails, active recreation, or municipal spray irrigation fields, beyond what's already required under the Chapter or Florida law, earns two dwelling units for every acre of publicly accessible land dedicated. The Board decides at its own discretion whether to accept any offered dedication. This bonus mechanism sits inside Chapter 17's Rural Conservation Subdivision Design Standards, which apply wherever the Comprehensive Plan requires a conservation subdivision, including the county's designated Rural Protection Areas, and may also be used voluntarily on property not otherwise subject to that mandate. The current bonus text was adopted by Ord. No. 2023-9, § 2, effective 1-24-23.
Violations & Fines
This section grants an incentive rather than imposing a duty, so there is no separate fine schedule tied to it. The 25% cap is hard: any bonus lots claimed without an approved open-space or public-access dedication backing them do not attach to the plat, and the Board of County Commissioners can deny a requested bonus outright even when an applicant meets one of the listed criteria. A developer who builds units above the base zoning density without Board approval of a bonus is subject to Lake County's general Land Development Regulations enforcement for platting outside an approved density.
