Summary

Monterey County grants a density bonus of up to 35 percent above the base zoning allowance for housing developments of five or more units that set aside affordable units, in all residential zoning districts of the unincorporated inland area. Title 21 implements state density bonus law, Government Code §§ 65915-65917; a separate Title 20 chapter covers the certified Coastal Zone.

City-specific rules exist: Salinas has its own density bonus law rules that differ from Monterey County's county-level regulations. If you live in Salinas, check the city-specific page instead.

Full Breakdown

65. 050, a housing development of five or more units qualifies for a density bonus plus at least one additional incentive if the applicant sets aside units for very low, low, or moderate income households, builds a senior citizen housing development, donates land to the County, or includes a qualifying child care facility. 060 fixes a sliding-scale bonus: setting aside 5 percent of base units for very low income households earns a 20 percent density bonus, rising toward the chapter's 35 percent cap as the set-aside percentage climbs; the low income and moderate income tables run on comparable sliding scales, and a senior housing development earns a flat 20 percent bonus.

No single application can exceed a combined 35 percent bonus, though a child care facility or land donation bonus can stack on top of an affordability-based bonus up to that same ceiling. 070 entitles a qualifying project to one to three additional incentives, such as reduced setbacks, increased lot coverage, increased building height, or reduced parking, scaled to how much affordable housing it provides. 40. 65 runs the same program inside the certified Local Coastal Program boundary, where the recorded affordability covenant runs 55 years instead of 30.

Violations & Fines

Chapter 21.65 does not itself impose a criminal penalty; it is an entitlement program. But § 21.65.120 requires the applicant to record a Density Bonus Housing Agreement enforcing the affordability restriction, and the County will not clear building permits for the bonus units without that recorded covenant on file. Failing to maintain the required rent or sales price levels, or phasing the affordable units out of step with the market-rate units, breaches the recorded agreement and exposes the developer to the County's contract enforcement remedies.

Frequently Asked Questions

How many units does a project need to qualify for a density bonus in unincorporated Monterey County?
Five or more residential units, per Monterey County Code § 21.65.050. The applicant must also commit to one of the chapter's affordability categories, such as reserving at least 5 percent of the base units for very low income households or 10 percent for low income households, to trigger the bonus and at least one additional incentive.
What is the maximum density bonus the county will grant?
Thirty-five percent above the project's base unit count, per § 21.65.060. That ceiling applies even when a child care facility or land donation bonus is combined with an affordability-based bonus; the two together cannot push the total above 35 percent of base units.
How long must the affordable units stay affordable?
At least 30 years under a recorded Density Bonus Housing Agreement, per § 21.65.120, or longer if a construction or mortgage financing program requires it. Units in the certified Coastal Zone follow the parallel Chapter 20.65 instead, which sets a 55-year affordability term.
