21.65.020 - Applicability. The provisions of this chapter are applicable in all residential zoning districts.
21.65.050 - Eligibility for density bonus. An application for a housing development containing five (5) or more residential units shall qualify for a density bonus and at least one other incentive as provided by this chapter if the applicant does one or more of the following:
A.Agrees to construct and maintain at least five (5) percent of the base units for very low income households;B.Agrees to construct and maintain at least ten (10) percent of the base units for low income households;C.Agrees to construct and maintain at least ten (10) percent of the base units in a condominium project or planned development project dedicated to moderate income households, provided that all units in the development are offered to the public for purchase;D.Agrees to construct and maintain a senior citizen housing development;E.Donates land to the County for the construction of very low income units pursuant to the provisions of this chapter; orF.Includes a qualifying child care facility in addition to providing housing described in Subsections A, B, or C of this section.

Violations & Fines
Chapter 21.65 does not itself impose a criminal penalty; it is an entitlement program. But § 21.65.120 requires the applicant to record a Density Bonus Housing Agreement enforcing the affordability restriction, and the County will not clear building permits for the bonus units without that recorded covenant on file. Failing to maintain the required rent or sales price levels, or phasing the affordable units out of step with the market-rate units, breaches the recorded agreement and exposes the developer to the County's contract enforcement remedies.
