Mendocino County adopted the current MU-2 General Mixed Use District chapter by Ordinance No. 4538 on September 10, 2024, replacing an older MU-2 chapter dating to 2014. 060, Mixed Use Development Review. 196 with CEQA review. Applicants for either permit track must submit a Mixed Use Development Plan with a detailed site plan, building elevation drawings showing exterior wall color and material and exterior lighting, a floor plan by use type, a landscaping plan, and a parking and circulation plan. The Zoning Administrator or Planning Commission must make supplemental findings that the project preserves neighborhood character, uses compatible materials and colors, and orients windows and outdoor areas to minimize heat, glare, and noise before approval can be granted.

Violations & Fines

Section 20.085.060(C) requires that supplemental findings be specific and evidence-based; failure to make the required findings "shall result in a denial of the Mixed Use Development Plan application," so an out-of-compliance project simply does not get approved. Once a plan is conditioned, the Planning Director notifies the County Building Official, and the Building Official may not approve a final inspection of the structure until every design condition has been satisfied, effectively blocking occupancy of a completed but non-conforming mixed-use building.
