Summary

Unincorporated Cobb County regulates redevelopment in old Downtown Mableton under County Code Section 134-286, a form-based code tied to the boundaries mapped in Table 1C of the South Cobb Town Center-Mableton Lifelong Community Plan adopted February 8, 2011. A Review Committee approves projects administratively, a Warrant Committee handles minor deviations, and any owner may instead build under the site's prior underlying zoning classification.

These county ordinances apply to unincorporated areas of Cobb County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(1)General procedures.(a)Intent. Due to the sustained lack of private investment in the old Downtown Mableton, it is necessary to institute development incentives to assist residences and businesses in having the community they desire. Therefore, the intent and purpose of this section is to enable and encourage the implementation of the South Cobb Town Center-Mableton Lifelong Community Plan (as adopted February 8, 2011) as depicted and expressly limited to the boundaries shown on Table 1C. The following policies provides further clarification on the intent for this section:1.The Mableton Community:...g.That compact, pedestrian-oriented and mixed use development should be enabled as a pattern of development...l.That civic, institutional, and commercial activity should be in downtowns, not isolated in remote single-use complexes.

Full Breakdown

Section 134-286 of the Cobb County Code creates the Mableton Form-based Redevelopment District, adopted February 22, 2011 and last amended July 26, 2016, to answer what the code calls the sustained lack of private investment in the old Downtown Mableton. The district implements the South Cobb Town Center-Mableton Lifelong Community Plan and applies only inside the boundaries plotted on the code's Table 1C transect-zone map; nothing outside that map is covered unless the Board of Commissioners approves an expansion. To add a new area, a petitioner must show at least 15 years of below-county-average development, documented blight, whether social, economic or physical, or inclusion in a Board-approved master plan or corridor study, then run a process that mirrors the original Mableton effort: a week-long, multi-designer workshop with public notice by road signs, direct mail, e-mail, website and print media, at least two public workshops, an illustrative master plan approved by the Board, and code language that tracks that plan.

Inside the district, the code activates its provisions with precise verbs: shall or are means mandatory, should means recommended, and may means optional. A Review Committee processes and approves applications administratively; owners who disagree with a ruling, or who need a deviation, have two paths. A warrant lets the Warrant Committee approve a practice that departs from a specific standard but still fits the section's general intent, with 15 days' notice to the Review Committee before the Warrant Committee meets and a 30-day window to appeal its decision to the Board of Commissioners through the zoning division manager. A variance, for any other deviation, goes straight to the Board of Commissioners with a planning commission recommendation. Owners are never locked in: any parcel may instead build under its prior underlying zoning, in which case the form-based standards do not apply. The district's rules otherwise override conflicting county codes except the fire code and the county's adopted International Building, Fire, Mechanical, Plumbing, Residential, Fuel Gas, Energy Conservation and Property Management Codes and the National Electrical Code.

Violations & Fines

Section 134-286 sets no separate fine schedule of its own. Projects that don't meet the form-based standards simply are not approved by the Review Committee, and building outside its dimensional or use limits without an approved warrant or variance falls under the same enforcement track as any other zoning violation: Cobb's Code Enforcement Division, created under section 2-101 to enforce zoning and planning ordinances. Adverse Review Committee or Warrant Committee rulings are appealed administratively to the Board of Commissioners, through the zoning division manager, rather than through Magistrate Court.

Frequently Asked Questions

Does the Mableton form-based code apply to my property if it's not in Mableton?
No. Section 134-286 applies only inside the boundaries Cobb County mapped on Table 1C for the Mableton Form-based Redevelopment District. Extending the transect-zone standards elsewhere requires a Board of Commissioners-approved expansion, which itself demands proof of at least 15 years of below-average development, documented blight, or a Board-approved master plan or corridor study, plus a week-long public design workshop before any new area is added.
Can a Mableton property owner still build under the old zoning rules instead of the form-based code?
Yes. Section 134-286(1)(b) lets an owner opt to use the property's existing underlying zoning district instead of the form-based standards; the county's regular zoning and development rules continue to apply to any parcel that makes that choice, and the form-based provisions only take precedence for owners who opt into them.
What if I need to deviate from a Mableton form-based standard?
Ask for a warrant if the deviation still fits the section's general intent; the Warrant Committee decides administratively after 15 days' notice to the Review Committee, and its ruling can be appealed to the Board of Commissioners within 30 days through the zoning division manager. Any other deviation is a variance, which only the Board of Commissioners can grant, on the planning commission's recommendation.
What incentives does Cobb County offer for building under the Mableton code?
The code directs the Board of Commissioners to adopt an incentives plan that may include fee reductions, density increases particularly for workforce housing, tax abatement through the development authority, and credit for green building certification. These incentives apply on top of the form-based standards themselves and are meant to offset the extra design requirements the district imposes.
