Summary

Antioch charges development impact fees on accessory dwelling units, but caps them below the standard per-unit rate. An ADU under 750 square feet pays no DIF at all, and larger units pay a size-proportioned share of the multifamily or single-family rate, whichever is less.

(D) Accessory dwelling units. DIFs shall be collected for accessory dwelling units as follows:

(1) Accessory dwelling units on multifamily properties shall pay the lesser of the following:

(a) The multifamily rate;

(b) The product of the following formula: (Square feet of accessory dwelling unit / Average square feet of all existing multi-family dwelling units on the same parcel) X Multifamily rate

(2) Accessory dwelling units on single- family properties shall pay the lesser of the following:

(a) The multifamily rate;

(b) The product of the following formula: (Square feet of accessory dwelling unit / Square feet of primary dwelling) X Single-family rate

(3) DIFs shall not be collected on accessory dwelling units smaller than 750 square feet in area.

Full Breakdown

50. Rather than charging an ADU the flat per-unit DIF assessed on a new single-family or multifamily unit, the Community Development Department calculates the fee two ways depending on the property type and applies whichever is lower. On a multifamily parcel, the ADU pays either the flat multifamily rate or the product of (square feet of the ADU divided by the average square footage of existing multifamily units on the parcel) times the multifamily rate. On a single-family parcel, the ADU pays either the multifamily rate or the product of (square feet of the ADU divided by square feet of the primary dwelling) times the single-family rate.

60(D)(3) exempts any accessory dwelling unit smaller than 750 square feet from DIFs entirely, meaning most small backyard cottages and converted garages owe nothing toward the city's four impact fee categories. 2(b)(1), which cap impact fees on ADUs statewide and bar them outright on units under 750 square feet; Antioch's ordinance was amended by Ord. 2181-C-S in March 2020 to bring the fee schedule into line with that state mandate. 60(A), and payment is due at issuance of that permit, not at final inspection or occupancy.

Violations & Fines

There is no separate penalty schedule for the ADU fee formula itself; DIFs are collected as a condition of building permit issuance, so a permit will not issue until the calculated fee, or the confirmed $0 exemption for a sub-750-square-foot unit, is paid or documented. Applicants who dispute the calculation bear the burden under § 9-3.70(A)(3) of providing factual proof to the Director of Community Development that a reduction or exemption applies; unresolved disputes delay permit issuance rather than triggering a fine.

Frequently Asked Questions

Does my Antioch ADU owe an impact fee?
Only if it is 750 square feet or larger. AMC § 9-3.60(D)(3) exempts any accessory dwelling unit smaller than 750 square feet from development impact fees entirely, regardless of whether it sits on a single-family or multifamily lot.
How is the fee calculated for a larger ADU?
The city compares two numbers and charges the lower one: the flat multifamily DIF rate, or that rate scaled by the ADU's square footage relative to the primary dwelling (single-family lots) or the average existing unit (multifamily lots), per AMC § 9-3.60(D)(1)-(2).
When is the ADU impact fee paid?
At the time the city issues the building permit, per AMC § 9-3.60(B), using whatever master fee schedule rate is in effect on that date, not the rate in effect when the application was submitted.
Does state law limit what Antioch can charge?
Yes. California Government Code § 65852.2(a)(1)(D)(xi) and § 65852.2(b)(1) prohibit impact fees on ADUs under 750 square feet statewide and require proportional fees on larger units; Antioch's § 9-3.60(D) formula was amended in 2020 to implement that state cap locally.
