Full Breakdown

Section 507(D)(5) ties owner occupancy specifically to junior accessory dwelling units: the property owner must reside in either the primary residence or the JADU, tracking Government Code § 65852.22(a)(2). The county's own standards for regular attached, detached or conversion ADUs in § 507(C) carry no comparable owner-occupancy condition, reflecting the state law change that suspended that requirement for standard ADUs statewide. A JADU must also be built within the walls of an existing or proposed single-family home, capped at 500 square feet, and limited to one per lot.

Violations & Fines

Occupying a JADU without the owner living on-site as required violates § 507(D)(5) and Government Code § 65852.22, and can result in the county withholding or revoking building or occupancy approval.

Frequently Asked Questions

Does the owner have to live on the property with a junior ADU?
Yes: the owner must live in either the main house or the JADU itself, per Development Code § 507(D)(5) and Gov. Code § 65852.22(a)(2).
Does the owner-occupancy rule apply to a regular detached ADU too?
No. Kings County's standard ADU rules in § 507(C) don't include an owner-occupancy condition: only junior ADUs carry it.
