Frequently Asked Questions

Can I rent out both my house and my ADU to different tenants?
No. Section 155.631(C) requires the lot owner to keep their primary residence in either the principal dwelling or the accessory dwelling unit; renting both to non-owner tenants means neither unit is the owner's residence, which no longer satisfies the ADU's establishment requirement.
Does the owner have to live in the main house specifically?
No. Section 155.631(C) lets the owner satisfy the requirement by living in either the principal dwelling or the accessory dwelling unit, so an owner can occupy the smaller ADU and rent out the main house instead.
What happens if I move away from the property?
If neither unit remains the owner's primary residence, the property no longer meets § 155.631(C)'s establishment and use condition, which exposes it to the zoning enforcement and misdemeanor penalties in § 155.9999.
Is owner-occupancy the only ADU requirement in York County?
No. It's layered on top of the separate district, size, parking and design standards in §§ 155.630 through 155.633, and on the prohibition in § 155.631(D) against using a manufactured home, RV, tiny house on wheels, travel trailer or camper as the unit.
