Dallas only allows accessory dwelling units in limited residential districts (R-7.5, R-10, R-16, RH series) and most ADUs require a Special Use Permit (SUP) or Specific Use Permit under Dallas Development Code Β§ 51A-4.217. Approval requires neighborhood notification, City Plan Commission hearing, and City Council vote. Building permits issue only after the SUP is granted. The process typically takes 6β12 months.
Dallas treats accessory dwelling units (ADUs) much more restrictively than California or even Austin. Under Dallas Development Code Β§ 51A-4.217, an ADU (called an 'accessory dwelling' in Dallas) is allowed by right in only a few districts and requires a Specific Use Permit (SUP) in most R (residential) districts. The SUP process includes a complete application to the Department of Sustainable Development and Construction, neighborhood notification within 200 feet, a public hearing before the City Plan Commission, and final approval by the City Council. Once approved, the applicant submits building plans for permit review through DallasNOW. ADUs must comply with detailed Development Code requirements: maximum 600 sq ft for detached units, maximum 25% of the main structure's floor area, owner occupancy of either unit, single-story preferred (two-story requires additional review), and standard residential setbacks under Β§ 51A-4.412. The Dallas City Code Chapter 53 building permit fees apply. There have been multiple City Council discussions to liberalize ADU rules but as of 2025 the SUP requirement remains for most districts. Properties in Conservation Districts (Munger Place, Swiss Avenue, Winnetka Heights) face additional review. Texas state law has not preempted Dallas's discretionary ADU process the way California state law has preempted San Diego's.
Building an ADU without an SUP and building permit is a Class C misdemeanor under Dallas City Code with fines up to $2,000 per day for building code violations and $500 per day for zoning violations under Texas Local Government Code Β§ 54.001. The city can order removal of unpermitted ADUs and place a lien for abatement costs.
