Full Breakdown

050 sets the eligibility requirements an Applicant and Dwelling Unit must meet to hold a Short-Term Rental Permit. Subsection (B) provides that the Dwelling Unit shall not be an ADU or JADU for which a construction permit was applied for on or after January 1, 2020. 030, an ADU or JADU permitted before January 1, 2020 is treated as part of the primary single-family residence for STR purposes, while one permitted on or after that date is excluded from the Primary Residence definition entirely and instead falls outside eligible STR inventory.

The same cutoff also determines classification for Partial-Home rentals, a pre-2020 ADU where the owner is physically present can qualify as a Partial-Home Short-Term Rental, but a post-2020 ADU cannot be rented short-term in any configuration. 450(F)(6). 080 annual renewal, and an ineligible ADU is grounds to deny or decline to renew the permit.

Violations & Fines

Operating a post-2020 ADU or JADU as a short-term rental fails eligibility under CVMC 5.68.050(B) and is grounds for permit denial under CVMC 5.68.070(J)(1) or renewal denial under CVMC 5.68.080(J)(1). If a permit was issued in error or the ADU's status changes, operating without a valid permit is a misdemeanor under CVMC 5.68.160(B), punishable by up to a $1,000 fine and six months in jail, with administrative citations available as an alternative starting at $1,000 for a first major offense.

Frequently Asked Questions

Can I short-term rent my new backyard ADU in Chula Vista?
No, if the construction permit for the ADU was applied for on or after January 1, 2020. CVMC 5.68.050(B) makes such units categorically ineligible for a Short-Term Rental Permit, regardless of who lives on the property.
What if my ADU's permit was applied for before 2020?
It can qualify. CVMC 5.68.030 treats an ADU or JADU permitted before January 1, 2020 as part of the primary single-family residence, so it can be rented as a Partial-Home Short-Term Rental if the owner is present, subject to the chapter's other eligibility rules.
Does this ADU restriction apply to Junior ADUs too?
Yes. CVMC 5.68.050(B) names both Accessory Dwelling Units and Junior Accessory Dwelling Units, applying the same January 1, 2020 construction-permit-application cutoff to both unit types.
