Summary

Sonoma County lets owners rent an accessory dwelling unit but bars selling it apart from the main house: an ADU cannot be sold or conveyed separately from the primary residence unless State law provides otherwise, and no ADU can be rented for thirty days or less. The rule sits in Zoning Code § 26-24-020(C) after Ordinance No. 6544, adopted December 9, 2025, repealed the old § 26-88-060.

City-specific rules exist: Petaluma, and Santa Rosa have their own adu rental restrictions rules that differ from Sonoma County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

Full Breakdown

Ordinance No. 6544, adopted December 9, 2025, repealed Section 26-88-060, so that old ADU section now reads "Reserved" in the Code. The ADU standards moved into Zoning Code Section 26-24-020, which implements Title 7, Chapter 13 of the California Government Code (Sections 66310-66341). Subsection C holds the two use restrictions that matter to owners and tenants.

Ownership and rental: an ADU can be rented, but it cannot be sold or otherwise conveyed separately from the primary residence unless State law specifically provides otherwise. Duration of tenancy: an ADU cannot be rented for periods of thirty days or less, so a stay must run at least thirty-one days. A junior ADU (JADU), which is capped at 500 square feet and sits entirely inside a single-family residence, follows a parallel rule in Section 26-24-150(C): it can be rented but not sold separately from the single-family residence.

The rental right comes with a ministerial permit path. A complete ADU application that meets the section's standards is approved without discretionary review or a hearing. When a primary dwelling already exists on the lot, the department has sixty days from a complete application to approve or deny it, and a denial must come with a full set of comments listing each defective item and how the applicant can fix it. The primary permit is a building permit, with grading, well, septic and sewer permits added where they apply.

Lot capacity shapes what can be rented. A lot with a single-family dwelling can hold two ADUs plus one JADU, and an ADU there can reach 1,200 square feet. A lot with an existing multifamily dwelling can add up to eight detached or attached new-construction ADUs, capped at the number of existing primary units. Additional parking is not required for an ADU, and no minimum lot size applies. A certificate of occupancy for an ADU cannot be issued before the one for the primary residence.

Violations & Fines

Selling or otherwise conveying an ADU apart from the primary residence breaks Section 26-24-020(C)(1) unless State law specifically allows it. Renting an ADU for thirty days or less breaks subsection (C)(2). This section prints no fine amount of its own. The permit consequences are concrete: the department denies a noncomplying application with written comments, and it will not issue an ADU certificate of occupancy ahead of the primary residence's certificate.

Frequently Asked Questions

Can I rent out my accessory dwelling unit in Sonoma County?
Yes. Section 26-24-020(C)(1) states that ADUs may be rented. The limit is on the length of the stay: under (C)(2) an ADU cannot be rented for periods of thirty days or less, so every tenancy has to run at least thirty-one days. The unit also has to stay with the primary residence for ownership purposes.
Can I sell my ADU separately from the main house?
No, with one carve-out. The County Code says an ADU cannot be sold or otherwise conveyed separately from the primary residence, except as specifically provided for by State law. A buyer takes the ADU only together with the primary residence unless a State statute separately authorizes the transfer.
Can an ADU be used as a short-term or vacation rental?
Not for stays of thirty days or less. Section 26-24-020(C)(2) bars renting an ADU for thirty days or less, which excludes nightly and weekly vacation-style bookings. The shortest permitted stay is thirty-one days. The same section governs both new ADUs and legalized older ones.
How long does Sonoma County take to approve an ADU?
When a primary dwelling already exists on the lot, the department must approve or deny a complete application within sixty days. Review is ministerial, with no discretionary review or hearing. If the ADU application is filed with a proposed primary dwelling, the ADU decision waits until the primary dwelling is approved or denied.
What happened to Section 26-88-060, the old ADU section?
Ordinance No. 6544, adopted December 9, 2025, repealed Section 26-88-060, and the Code now lists it as Reserved. Its ADU rules, including the rental and sale restrictions, were restated in Zoning Code Section 26-24-020, which also covers unpermitted ADUs created before January 1, 2020.
