Summary

Lynchburg zoning lets a single-household lot add one accessory dwelling unit, either tucked into the main house behind a shared entrance or built as a detached structure in the rear yard outside the setback lines. A detached unit is capped at 900 square feet and one bedroom, and still has to meet the lot's own parking and coverage limits.

Sec. 35.2-71.3. - Dwellings units accessory to single-household residences. Dwellings units, which include guest houses, caretakers' cottages and other residential accommodations, may be established accessory to a single-household residence either in the principal dwelling or as a detached accessory structure subject to the following provisions: (a)Accessory dwelling units shall be located within the principal structure using a common entrance so that the principal structure retains the appearance of a single-household residence, or be located in an accessory structure located in the rear yard and outside required setback lines for principal structures.(b)The occupancy shall not exceed the limits established in the applicable zoning district.(c)Detached accessory dwelling units shall be limited to 900 square feet and shall not have more than one bedroom.(d)Accessory dwellings shall comply with all applicable parking, building coverage and rear yard building coverage requirements.

Full Breakdown

3 authorizes "dwellings units," defined to include guest houses, caretakers' cottages and similar residential accommodations, as accessory to a single-household residence. There are two allowed configurations. First, the unit can be located inside the principal structure, but it must use a common entrance so the house still reads from the street as a single-family home rather than a duplex. Second, it can be a detached accessory structure, but only if placed in the rear yard and entirely outside the setback lines that apply to principal structures.

Whichever configuration is chosen, occupancy of the ADU can't push the lot's total occupancy past whatever limit the underlying zoning district already sets for that property. Detached units carry an extra size cap not applied to the attached option: no more than 900 square feet of floor area and no more than one bedroom, which keeps a garage-apartment or cottage from functioning as a second full household. Finally, an ADU of either type has to comply with the same parking requirements, building coverage limits and rear-yard building coverage rules that apply to any other structure on the lot, so adding one can't be used to sidestep the district's overall density and coverage math.

Violations & Fines

The Zoning Administrator enforces ADU compliance the same way as other zoning standards. An unpermitted second entrance, an oversized detached unit, or coverage that busts the lot's limits draws a written notice of violation with up to 90 days to fix it. Continuing noncompliance is a misdemeanor punishable by a fine of up to $1,000 under § 35.2-102.2, or escalating civil penalties of $200 to $500 per violation under § 35.2-102.4, with an appeal available to the Board of Zoning Appeals within 30 days.

Frequently Asked Questions

Can I build a detached ADU behind my house?
Yes, Section 35.2-71.3(a) allows a detached accessory dwelling unit if it sits in the rear yard, outside the setback lines that apply to the main house, and stays within the 900-square-foot, one-bedroom cap set by subsection (c).
Does an ADU inside my house need a separate front door?
No, it can't have one. Section 35.2-71.3(a) requires an ADU built inside the principal structure to use a common entrance so the house keeps the outward appearance of a single-household residence.
How many bedrooms can a detached ADU have?
Just one. Section 35.2-71.3(c) limits detached accessory dwelling units to 900 square feet of floor area and no more than a single bedroom, regardless of the lot size.
Does adding an ADU change my parking requirement?
It doesn't waive it. Section 35.2-71.3(d) requires an accessory dwelling unit to comply with all applicable parking, building coverage and rear-yard building coverage requirements that already apply to the lot.
