Islip's Town Code does not single out carports; they are regulated as accessory structures under Chapter 68 (e.g. Sec. 68-45 for the Residence AAA District) and the General Zoning Standards Chart. An accessory structure 'may not be located in a primary front yard, with the exception of Residences on Fire Island, and is subject to front, side, and rear-yard setbacks based on the size of the accessory structure.' For front-yard placement behind the front face of the house, a structure 6 feet or less in height must be set back at least 4 feet and one over 6 feet at least 20 feet. Side and rear setbacks are 2 feet for structures of 144 square feet or less, 4 feet for those greater than 144 and less than 500 square feet, and 10 feet for those 500 square feet or larger. Maximum height is 14 feet in residential zones AAAB, BAA, AAA, AA, A, B and CAA and 18 feet in GST, CA and RRD. In residential zones AAA, AA, A and B, accessory buildings may occupy no more than 10% of the total lot area and 25% of the rear yard area and may not exceed the gross floor area of the main dwelling, and at least 40% of the rear yard must remain landscaped earth.
A carport or other accessory structure placed in a primary front yard, exceeding the height cap, or violating setback and rear-yard occupancy limits must be removed or relocated, or the owner must obtain a variance from the Zoning Board of Appeals.
