Under California Government Code Section 65852.2, as amended by AB 68 and AB 881, Alameda County must allow conversion of an existing attached or detached garage or other accessory structure into an ADU ministerially. No replacement parking is required when a garage is converted to an ADU, even if the zoning previously required covered parking. The converted ADU must meet health and safety requirements including fire-rated walls, egress windows, minimum ceiling heights (generally 7 feet per CRC), smoke and carbon-monoxide alarms, insulation, and proper plumbing and electrical. Garage slabs often need vapor barriers or re-pour for the conversion to meet residential standards. A building permit is required but no discretionary zoning review. Conversion of a garage to habitable space that is not an ADU (for example, a den or bedroom) follows the normal building permit process and may require replacement parking under Alameda County zoning.
