Berkeley allows garage-to-ADU and garage-to-JADU conversions under BMC 23.306, consistent with California Government Code Β§65852.2. No replacement parking is required when a garage is converted to an ADU, and the existing garage's setbacks are preserved for the converted footprint.
BMC 23.306 implements state ADU rules that prohibit Berkeley from requiring replacement parking when an existing garage is converted to an ADU. Conversions that stay within the existing building envelope are reviewed ministerially. A conversion ADU that does not modify the existing accessory structure envelope beyond what BMC table 23.306-2 allows may add up to 150 square feet to accommodate ingress/egress and required code compliance, per BMC 23.306. A JADU created in an attached garage is capped at 500 sq ft and must be within the walls of the primary single-family dwelling β owner-occupancy of the primary residence or the JADU is required, recorded as a deed restriction. Conversions still require a building permit and must comply with the California Residential Code (egress, fire separation between the ADU and primary dwelling where attached, smoke and CO alarms, light and ventilation).
Converting a garage to living space without a building permit is a Berkeley code violation that may trigger stop-work orders, fines, and required restoration of the garage. Self-certified 'unpermitted' conversions are not eligible for the BMC 23.306 ministerial path until properly permitted.
