Full Breakdown

220 separates garage conversions into two tracks. 41, Article I. Subsection B covers the more common case, converting an attached garage into ordinary living space for a single-family detached residence. Before that conversion is legal, the property owner must sign a written statement absolving the city of liability for any deed restrictions on the property, replace the garage with 2 covered or uncovered, surfaced, off-street parking spaces sited to match the neighborhood's character, preserve interior access between the former garage and the house, eliminate any door that opens directly onto the street, and complete the work under full permits and inspections from every applicable city department, plus satisfy the city's design guidelines for architectural quality and compatibility.

Subsection C separately addresses conversions done without permits: an illegal conversion discovered by the city gives the owner 30 days to request inspection from the building and safety division, after which the owner must either correct any building code deficiencies and provide the 2 replacement parking spaces to legalize the space, or remove the conversion and restore the garage to its original function.

Violations & Fines

A garage converted without permits is deemed an illegal garage conversion under Section 17.08.220(C). Once notified, the owner has 30 days to request a building and safety division inspection and pay required fees; failure to either correct cited deficiencies and add the 2 replacement parking spaces, or remove the conversion and restore the garage, leaves the owner subject to the citywide Section 1.12.020 penalty schedule of infraction or misdemeanor fines up to $1,000 and six months in jail.

Frequently Asked Questions

Do I need to replace parking if I convert my Lancaster garage to a bedroom?
Yes. Section 17.08.220(B)(2) requires 2 covered or uncovered, surfaced, off-street parking spaces on the property, arranged to match the neighborhood's character, before the conversion is legal.
Can I put a new front door where my Lancaster garage door used to be?
No. Section 17.08.220(B)(4) prohibits any door access into the former garage that faces the street, so the exterior wall facing the street must be finished without a street-facing entrance.
What happens if I already converted my garage without permits in Lancaster?
The city treats it as an illegal garage conversion under Section 17.08.220(C). Within 30 days of notice, you must request an inspection from the building and safety division, then either fix any code deficiencies and add the required replacement parking, or remove the conversion and restore the garage.
