Kern County's Chapter 19.90 ADU rules let homeowners convert an existing garage into an ADU subject to size and standards, but other garage conversions to living space still require a building permit and zoning compliance.
Under Kern County Code of Ordinances Title 19, Chapter 19.90 (Accessory Dwelling Units), the maximum floor area for an attached or interior-conversion ADU - which is the path used for converting an existing attached garage into a living unit - is 1,200 square feet or 50 percent of the total floor space of the principal dwelling, whichever is less. The ADU must contain separate kitchen and bathroom facilities and a separate entrance, and either the principal dwelling or the ADU must be owner-occupied (§ 19.90.030). Consistent with California state ADU law incorporated into Chapter 19.90, when a garage, carport, or covered parking structure is demolished or converted to create an ADU, the county does not require replacement of the displaced off-street parking spaces. Garage conversions that do not produce a permitted ADU but instead add living space to the main dwelling still require a building permit under Kern County Code § 17.08.060 (only one-story detached sheds 120 sq ft or less are permit-exempt) and must comply with the zoning district's setback, height, and floor-area standards as well as Title 17 building, electrical, plumbing and energy code requirements adopted by Kern County.
Converting a garage to habitable space without permits is a building and zoning code violation. Kern County can issue stop-work orders, require restoration or permit-by-correction with penalty fees, and prosecute zoning violations as misdemeanors under Title 19; unpermitted ADUs are also ineligible for the state-mandated ministerial approval process.
