The County must process the building permit ministerially within 60 calendar days. If a garage that provided required parking is converted, replacement parking may or may not be required depending on the parking provisions of Chapter 11.25 and state law; converting a non-required structure generally does not trigger new parking. A building permit and compliance with the Building Code (light, ventilation, egress, kitchen, bathroom) are required.
Converting a garage to a habitable dwelling or ADU without a building permit, or creating an unpermitted second unit, is a zoning and building-code violation subject to code enforcement, red-tag, and nuisance abatement.
