Butte County Code section 26-3.1, which adopts California Building Code section 105.2 with local amendments, exempts certain small accessory structures from building permits. Specifically, Form DBP-20 published by the Butte County Department of Development Services lists 'one-story detached accessory structures used as tool and storage sheds, playhouses and similar uses' as exempt from building permits provided the floor area does not exceed 120 square feet. Even though no building permit is needed, the structure must still meet zoning setbacks established by the underlying zone, and any utilities (electrical, gas, plumbing) serving the shed require their own permits. Sheds larger than 120 sq ft are treated as 'accessory structures' regulated by Section 24-156 of the zoning code and must meet that section's setback rules: side and front-yard setbacks the same as the primary structure, and a five-foot rear setback for structures 15 feet or less in height (matching the primary structure's rear setback if taller). There are no required setbacks for small sheds, playground equipment, well houses, and similar small accessory objects 'not attached to a permanent foundation,' per Section 24-156. Agricultural shade-cloth structures, water tanks under 5,000 gallons, and retaining walls under 4 feet are also exempt from permits.
Installing a shed in violation of zoning setbacks, or installing electrical/plumbing/gas service to a shed without permits, can result in code enforcement notices, mandatory removal or relocation of the structure, and permit reinspection fees. Stop-work orders may issue for unpermitted utility installations.
