Monterey County follows the California Building Code adopted in Title 18 (§ 18.02). Per the County's Building & Planning Services FAQ, a construction permit is not required for a one-story detached accessory structure used as a tool/storage shed or playhouse, provided floor area does not exceed 240 square feet and the structure contains no electrical, plumbing, or mechanical work and is not used to store hazardous material. Even when a building permit is not required, Title 21 zoning standards still apply. For Low Density Residential (LDR) districts under § 21.14.060, non-habitable accessory structures must observe a 50-foot front setback, six feet on the front half of the lot and one foot on the rear half of the lot for side setbacks, and one foot from the rear lot line, with a maximum height of 15 feet. Habitable accessory structures in LDR require six-foot side and rear setbacks and a 50-foot front setback, also capped at 15 feet. Structures structurally attached to the main dwelling take the same setbacks and height as the main structure (§ 21.62.030(D), § 21.62.040(K)). Detached accessory structures with alley access must remain at least six feet from the alley right-of-way (§ 21.62.040(L)). Setbacks and design control requirements vary by zoning district and should be confirmed with HCD Planning before construction.
Building any accessory structure that exceeds 240 sf, includes electrical/plumbing/mechanical, or violates Title 21 setback or height standards without permits is a code violation. Code Compliance may issue notices of violation, require permits after the fact (often at higher fees), or order removal or modification of the structure. Continuing violations may accrue daily administrative penalties.
