Summary

In unincorporated Whitfield County, an accessory structure built with or after the main house on a lot under three acres zoned single-family residential cannot exceed 1,500 square feet or the house's own footprint, whichever is smaller, and its eave height tops out at 12 feet for one story or 18 feet for two. The Unified Zoning Ordinance sets these caps for sheds, garages, carports and shelters.

These county ordinances apply to unincorporated areas of Whitfield County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)Accessory structures constructed concurrent with, or subsequent to, the primary dwelling structure, including, but not limited to, open sheds, garages, carports, and shelters are permitted upon a parcel less than three (3) acres in area and zoned for or used for single-family residential purposes only if the accessory structure is no larger than the gross floor area of the primary dwelling or fifteen hundred (1,500) square feet, whichever is lesser, and shall not exceed twelve (12) feet in height at the eave level for a single story or eighteen (18) feet in height at the eave level for two (2) stories. ... (b)Within the R-5, SA, or GA zoning districts, accessory structures constructed concurrent with, or subsequent to, the primary dwelling, may also store tools, currently tagged vehicles and/or equipment utilized in the trade or business occupation of the person or persons occupying the principal dwelling structure only if all of the following additional conditions are met:(1)The accessory structure is no larger than the gross floor area of the primary dwelling or fifteen hundred (1,500) square feet, whichever is lesser, and provided that all applicable building setbacks are met.

Full Breakdown

Section 4-6-10 of the Unified Zoning Ordinance (Appendix A) governs accessory structures raised alongside or after a single-family home on parcels of less than three acres. The structure cannot be larger than the primary dwelling's own gross floor area or 1,500 square feet, whichever is smaller, and it is capped at 12 feet of eave height for a single story or 18 feet for two stories. In the R-5, SA and GA zoning districts, the same size-capped accessory building may also double as storage for tools, currently tagged vehicles and equipment tied to a home-based trade or business, but only if it stays fully enclosed, meets every applicable building setback, holds no more than two commercially licensed vehicles weighing 14,000 pounds gross vehicle weight or less, and never houses heavy equipment like bulldozers, dump trucks or backhoes.

The ordinance also bars business invitees or customers from visiting the property and prohibits any manufacturing, construction, shipping or processing of commercial goods inside the structure. Separately, Whitfield County's building permit rule at Section 5-37 exempts one-story detached tool and storage sheds, playhouses and similar structures from needing a permit at all, but only if the floor area stays at or under 200 square feet; anything larger, or any shed used for the home-occupation storage allowed under Section 4-6-10, still needs a permit from the Building Inspections office before construction begins.

Violations & Fines

The Zoning Administrator, a Whitfield County Code Enforcement Officer, or a Sheriff's Deputy can cite an oversized or non-conforming accessory structure under Section 11-4 of the Unified Zoning Ordinance, and Section 11-6 treats every day the violation continues as a separate offense. Section 11-7 sets the penalty at up to $1,000.00 or 60 days in jail, or both, under O.C.G.A. § 36-1-20(b), with each additional day punishable again. Section 11-9 first requires a 30-day written notice to bring the structure into compliance before the case goes to the Board of Commissioners for a hearing.

Frequently Asked Questions

How big can a shed be in unincorporated Whitfield County?
Under Section 4-6-10 of the Unified Zoning Ordinance, an accessory structure built with or after your house on a parcel under three acres cannot exceed 1,500 square feet or the size of the house itself, whichever is smaller. Height is capped at 12 feet at the eave for a single story or 18 feet for two stories, regardless of lot size within that acreage limit.
Do I need a permit to build a shed?
Section 5-37 of the county's building code exempts one-story detached tool and storage sheds of 200 square feet or less from needing a building permit. Anything larger, or any accessory structure used to store a work vehicle or trade equipment under Section 4-6-10, requires a permit from Whitfield County Building Inspections before construction starts.
Can I keep a work truck in my backyard shed?
Only in the R-5, SA and GA zoning districts, and only if the structure is fully enclosed, meets every building setback, and holds no more than two commercially licensed vehicles weighing 14,000 pounds gross vehicle weight or less. Bulldozers, dump trucks and similar heavy equipment are never allowed inside, and customers cannot visit the property for business.
