Tiny home rules in Austin, TX β covering tiny houses on wheels (THOWs), park model RVs, and tiny home on foundation builds β determine where they are legal and how they get permitted.
Austin is among the most tiny-home-friendly cities in Texas, allowing ADUs on most SF lots down to 5,750 sf and permitting DADUs (Detached ADUs) with reduced setbacks under HOME Initiative amendments. Texas Property Code and local SMART Housing incentives promote affordable tiny-home development.
Austin's 2023β2024 HOME Initiative (Home Options for Middle-Income Empowerment) significantly expanded tiny-home and ADU flexibility. Under the updated LDC Chapter 25-2, most SF-3 lots (over 5,750 sf) can have up to three units β a primary dwelling plus two ADUs, or two detached units on a single lot. ADUs can be up to 1,100 sf or 0.15 FAR, whichever is greater. Setbacks for ADUs have been reduced to 5 feet side/rear and 10 feet from alleys. Height is limited to 30 feet or the primary structure. Tiny homes on permanent foundations are treated as ADUs and must meet residential code (2021 IRC with Appendix Q for units under 400 sf) including insulation, egress, and heating. Tiny homes on wheels (THOWs) are treated as RVs and cannot be occupied as permanent dwellings on residential lots β they require an RV park or agricultural zoning. Austin SMART Housing policy waives development fees and expedites permits for income-restricted affordable units, making ADU tiny homes a popular tool. The Heritage Tree Ordinance still applies β ADU siting must avoid protected tree root zones.
Specific penalty amounts for this ordinance are not published in a publicly accessible fine schedule. Contact Austin code enforcement directly for current fines, enforcement procedures, and hearing options.
