Florida Statute §586.10 preempts local beekeeping regulation. Hillsborough County and HOAs cannot prohibit beekeeping on residential parcels where the beekeeper is registered with the Florida Department of Agriculture and Consumer Services (FDACS).
All hives must be registered annually with FDACS (free, online). Best management practices include water sources, requeening Africanized hives, and adequate setbacks from neighbors. Hillsborough HOAs may impose setback or hive-count limits within state BMP guidelines but cannot outright ban registered apiaries.
Unregistered apiaries face FDACS enforcement under §586. Local code can enforce nuisance complaints if BMPs aren't followed.
