Summary

Prince George's County protects young birds from exploitative sale and mistreatment under Code Section 3-183. The law bars selling, raffling or giving away chicks, ducklings, or other fowl under four weeks old in lots smaller than a dozen, prohibits dyeing or coloring them, and bans giving away any live bird, fish or animal as a contest prize or business inducement.

These county ordinances apply to unincorporated areas of Prince George's County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)No person shall sell, offer for sale, raffle, barter, or give away baby chickens (chicks), ducklings or other fowl under four (4) weeks of age in lots of less than one dozen, or rabbits under six (6) weeks of age, or any unweaned mammalian companion animals including said animals under the age of eight (8) weeks as prohibited by State law; or color, dye, stain, or change the natural color of baby chickens, ducklings, other fowl, or rabbits; or bring or transport the same into the County. ... (c)No person shall give away any live animal, fish, or bird as:(1)A premium, novelty, toy, or prize, or as an inducement to enter any contest, game, or other competition;(2)An instrument to enter a place of amusement;(3)An incentive to enter into any business agreement where the offer was for the purpose of attracting trade.(d)Any person who violates the provisions of this Section is subject to the fine set forth in Section 3-116 of this Code, as well as confiscation of the animal(s) involved.

Full Breakdown

Section 3-183 of the Prince George's County Code, in the Animal Control subtitle's rules on selling and giving away baby fowl, makes it unlawful to sell, offer for sale, raffle, barter, or give away baby chickens, ducklings, or other fowl under four weeks old in lots of less than one dozen, rabbits under six weeks, or unweaned mammalian companion animals under eight weeks as already barred by State law. It is separately unlawful to color, dye, stain, or otherwise change the natural color of baby chickens, ducklings, other fowl, or rabbits, or to bring animals already treated that way into the county.

Breeders and commercial raisers are exempt from the age and lot-size limits if their facilities comply with the Health Officer's rules, and stores selling chicks, ducklings, or fowl in lots of twelve or more must provide brooders or other heating devices along with constant food and water to keep the birds healthy while on display. Subsection (c) separately bans giving away any live animal, fish, or bird as a premium, novelty, toy, or prize, as an inducement to enter a contest, game, or competition, as an instrument to enter a place of amusement, or as an incentive to enter a business agreement meant to attract trade, with the only exception carved out for animals given away for agricultural purposes.

The provision traces to County Bill CB-36-1985, amended by CB-63-1994 and CB-46-2019, and it works alongside Section 3-185, which lets the Commission for Animal Control or the Health Officer order abatement action when pigeons are found to be a public or private nuisance.

Violations & Fines

Section 3-183(d) subjects any violator to the fine set out in Section 3-116, plus confiscation of the animals involved. Section 3-116(a)(2) sets that fine at $100 for a first violation, $500 for a second violation, and $1,000 for each subsequent violation. The Animal Management Division and the Commission for Animal Control enforce the section and may seize animals sold, dyed, or given away in violation of it.
