California Food and Agricultural Code section 31683 preempts any city or county from adopting breed-specific legislation that bans or restricts particular breeds such as pit bulls, Rottweilers, Dobermans, or mixes. Isleton therefore has no breed ban, and landlords or HOAs that attempt breed restrictions are acting under private policy, not city law. The one narrow state-law carve-out in Health and Safety Code 122331 allows cities to adopt breed-specific mandatory spay and neuter or breeding permit programs, but not outright bans. Isleton has not adopted a breed-specific spay/neuter program. Dangerous or vicious dog determinations are made under Food and Ag Code 31601 through 31683 based strictly on the individual dogs behavior such as biting without provocation, and Sacramento County Animal Services handles those hearings.
No breed-based citations can issue. Owners of dogs that bite or behave dangerously may face impoundment, mandatory muzzling, secure enclosure requirements, or euthanasia orders following a dangerous-dog hearing.
