Eagan amended its City Code to permit backyard chickens after a City Council vote. Residents on property zoned for single-family residential use may keep up to five chickens in a coop with an adjacent run, provided they obtain a permit from the City. Roosters are prohibited to address noise concerns. The chicken run must be fully enclosed, and both the coop and run must be located in the rear yard of the residence. Setbacks require the coop and run to be at least 25 feet from any inhabitable building, at least 10 feet from the rear lot line, and at least 5 feet from the side lot lines. The permit fee is $50, and holders must reapply annually and pass a city inspection before issuance or renewal. The ordinance prohibits slaughtering chickens on residential property and prohibits selling the eggs. Larger numbers of poultry and other farm animals are handled separately under the City's agricultural rules, which require agricultural zoning and a minimum of five acres. The Eagan Police Department's animal control officer conducts inspections of animal-keeping facilities, including chicken permits.
Keeping chickens without a permit, keeping roosters, exceeding five hens, ignoring setback or rear-yard placement rules, slaughtering chickens on residential property, or selling eggs violates the City Code and can lead to enforcement and loss of the permit at the annual inspection.
