Eagan permits backyard BBQ and propane grilling at single-family homes, but City Code Sec. 10.40 and the Minnesota State Fire Code restrict multi-family grilling. In buildings with three or more dwelling units, grills (electric, gas, charcoal, or open flame) may not be used or stored on any above-ground balcony or ground-floor patio within 15 feet of the structure.
Outdoor cooking at detached single-family homes in Eagan is generally unrestricted, subject to common-sense fire safety and the recreational fire rules if an open fire is involved. The key regulation is for multi-family housing. Under Eagan City Code Chapter 10, Section 10.40, in any structure containing three or more dwelling units that share a common hallway or means of egress, no grill - whether electric, gas, charcoal, or open flame - may be used or stored upon any balcony above ground level, or on any ground-floor patio within 15 feet of the structure. The adopted Minnesota State Fire Code (Appendix O) mirrors this: no person may kindle or maintain any fire or open flame, or store or use fuel, barbecues, or torches, on those balconies and patios. A narrow exception allows permanently mounted electric or gas-fired grills that are wired or plumbed to the building's systems, with at least 18 inches of clearance, when approved by the fire chief. Propane cylinders must be stored outdoors at least 10 feet from building openings such as windows, doors, and fresh-air intakes. These rules apply citywide for apartments, condos, and townhomes with shared egress; the City directs grilling questions to the Fire Marshal at 651-675-5905.
Using or storing a grill on an above-ground balcony, or within 15 feet of a multi-unit (3+ dwelling) building, violates Eagan City Code Sec. 10.40 and the adopted Minnesota State Fire Code, enforced by the Eagan Fire Department through warnings, correction orders, and citations.
