Eagan, MN Noise Ordinances: Construction Hours (2026)

Eagan City Code § 10.37, Subd. 1 declares it unlawful, between 10:00 p.m. and 7:00 a.m. on any public or private property, to run construction activity such as operating, repairing, or starting and warming up heavy construction equipment, loading and unloading heavy equipment, or delivering supplies. The same nighttime window bars power tools used for construction, including saws, jackhammers, nail drivers, impact wrenches, and air compressors, and it bars power lawn or landscape maintenance equipment such as lawn mowers, hedge clippers, grass and weed trimmers, garden tillers, chainsaws, leaf blowers, and wood chippers.

Repairing or servicing motor vehicles, recreational vehicles, or other vehicles and equipment during those hours is also prohibited. Subd. 2 carves out several exemptions: mining and excavation work under a mining and excavation permit; activities and land uses authorized by a conditional use permit, including fuel facilities, fast-food establishments, major auto repair, school activities, and day care facilities; public work construction and maintenance performed by federal, state, county, or city authorities or their contractors as approved by the city engineer; snow removal; emergency public works repair and construction; and parking lot maintenance or sweeping.

This nighttime construction ban sits alongside Eagan's separate noisy-gathering ordinance at Section 10.31, which presumes a violation whenever noise from a gathering is plainly audible 50 feet away between 10:00 p.m. and 7:00 a.m. Community Development and the Eagan Police Department enforce complaints about equipment or construction running after hours.
