Barking dog rules in Eagan, MN β also called nuisance dog, dog noise, or excessive barking ordinances β define when a barking dog becomes a code violation and how complaints are handled.
Eagan City Code Section 10.11 makes it a public nuisance for the owner of any dog or cat to permit the animal to habitually bark, cry, whimper, howl, whine, or emit other loud or unusual noises. The rule applies at all hours; residents report active barking to the Police Department's non-emergency line.
Eagan handles animal noise as a public nuisance under City Code Section 10.11 (Dog, cat, ferret and horse regulation and dog licensing), Subdivision 6. The ordinance states it is unlawful for the owner of any dog or cat to 'permit such animal to habitually bark, cry, whimper, howl, whine, or emit any other loud or unusual noises.' The City's Animal Control materials explain that the rule requires owners to prevent all types of pets from habitually disturbing the peace, and that although nuisance pet noise is prohibited at all times, it becomes a greater problem during the hours when most people sleep. The word 'habitually' is important: an isolated bark is generally not a violation, but repeated or sustained barking that disturbs neighbors can be. The same Section 10.11 also limits most households to a combined total of three dogs and/or cats over four months of age without a kennel permit, and prohibits animals running at large. To report a dog that is actively barking, the City directs residents to call the Eagan Police Department non-emergency number, 651-675-5700, and an officer will respond. Violations of the animal nuisance provisions are enforced through the City Code's misdemeanor penalty in Section 10.99.
Habitual barking is a public nuisance under Section 10.11 and is enforced by Eagan Police/Animal Control; underlying City Code violations are misdemeanors under Section 10.99.
