Eagan sits under Minneapolis-St. Paul International (MSP) flight paths, but aircraft noise is not a city ordinance matter. The Metropolitan Airports Commission (MAC) responds to all aircraft and airport noise concerns, and the FAA regulates jet engine noise. Eagan's City Code noise rules do not apply to aircraft in flight.
Eagan lies just south of Minneapolis-St. Paul International Airport (MSP) and under its flight paths, so aircraft noise is a frequent concern, but it is handled outside the City Code. Minnesota's noise framework assigns aircraft noise to two agencies. The Metropolitan Airports Commission (MAC) 'responds to all concerns regarding noise relating to aircraft or the airports' and is responsible for all noise issues related to MSP and its reliever airports. The Federal Aviation Administration (FAA) has source regulations for commercial jet engines, requiring all commercial jet engines to meet noise emission criteria before being certified for flight; however, the MPCA notes that the MAC is the best contact for noise concerns related to its airports. Eagan's own noise ordinances (Sections 10.37 and 10.42 and the disturbing-the-peace rules) govern ground-based noise such as parties, equipment, and stereos, not aircraft overflights. Because federal law preempts most local regulation of aircraft in flight, the City cannot set decibel limits or curfews on planes. Residents bothered by aircraft noise are directed to the MAC's noise program rather than to Eagan Police. The MAC operates noise monitoring, complaint tracking, and abatement programs (such as runway-use and flight-track procedures) for the MSP area that covers Eagan.
Not a City Code matter. Aircraft noise complaints are directed to the Metropolitan Airports Commission (MAC) noise program; jet engine noise standards are set and enforced federally by the FAA. Eagan ordinances do not penalize aircraft overflights.
