The City of Auburn's Animal Control program requires that dogs be kept under restraint at all times. Under the City Code (the City cites Sections 4-16 and 4-17), a dog is considered under restraint when it is confined in a building, fenced pen or fenced yard on the owner's property (or another's property with consent); leashed; properly tethered on the owner's property so it cannot reach public or other private property; or, though not otherwise restrained, in a peaceful attitude on the owner's property while wearing current rabies vaccination tags. The City advises that pets not be allowed to run loose and instead be confined by fence or leash. According to the City's Open Line publication, dogs may be off-leash only at designated dog parks, and only if they remain under immediate and effective voice control of their owners. Auburn does not require a separate dog license, but owners must have proof of rabies vaccination. Animal Control (334-501-3090) responds to dogs running at large. State law (Ala. Code Section 3-7A-14) leaves the power to prohibit dogs from running at large to municipalities like Auburn.
Failure to keep a dog under restraint can result in the dog being impounded by Animal Control and a citation under the City Code. Owners are also liable under Alabama Code Section 3-6-1 for injuries a dog causes when it bites someone without provocation in a place the person is lawfully present.
