" This works alongside Subsection A's separate At Large ban, which applies to any unleashed dog on public property or on private property without the owner's permission (cats in heat aside, cats are otherwise exempt from the At Large rule, not the leash-length rule). An Animal Control Officer or police officer who personally observes an unleashed or over-length-leashed dog in a public place may issue an appearance ticket under § 310-19, and the dog may be seized and taken to a Town-designated shelter if the owner cannot be located.

An impounded dog can be redeemed by proving current licensing and paying a $30 impoundment fee plus $15 for each additional 24-hour period the dog remains sheltered; per § 310-19(H), an owner whose dog was seized as a suspected Dangerous Dog under state Agriculture and Markets Law § 123 must pay those same fees unless a Town Justice finds the dog is not dangerous and there was no violation. Under § 310-14, proof that a dog was running or being At Large is presumptive evidence against the licensed owner or harborer.
