Summary

In unincorporated St. Martin Parish, Louisiana, Sec. 6-26 requires every owner or attendant to keep a domestic animal under restraint at all times. Away from the owner's property the animal must be securely fastened to a leash, in a pet carrier or cage, or in a vehicle. A first failure to restrain costs $15.00, $35.00 or $50.00, depending on vaccination and spay or neuter status.

These county ordinances apply to unincorporated areas of St. Martin Parish. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)Each owner and/or attendant shall keep his domestic animal under restraint at all times to prevent the escape from his property or person and shall prevent his animal from threatening, attacking, and/or biting any lawfully acting person or animal.(b)When off the property of the owner or attendant, every domestic animal must be securely fastened to a leash, in a pet carrier/cage, or in a vehicle. ... (g)Any owner or attendant who violates any provision of this section shall be guilty of failure to restrain.(1)For the first offense of this section, and any subsequent offense of this section occurring more than one year from a previous violation of this section, an owner or attendant shall be fined $15.00 for failing to restrain an animal that is vaccinated and spayed/neutered; $35.00 for failing to restrain a unvaccinated spayed/neutered animal; $50.00 for failing to restrain a un-vaccinated un-spayed/un-neutered animal; plus a $5.00 per additional day fee for care and feeding while in the care and custody of St. Martin Parish Animal Control.

Full Breakdown

The restraint rule is Sec. 6-26 in Chapter 6 (Animal Codes) of the St. Martin Parish Code of Ordinances. Subsection (a) makes each owner and/or attendant responsible for keeping a domestic animal under restraint at all times, so it cannot escape from the property or person and cannot threaten, attack or bite any lawfully acting person or animal. Subsection (b) adds the off-property rule: leash, pet carrier or cage, or vehicle. Sec. 6-1 defines restraint as control that keeps the animal in or on the owner's or attendant's property, or on a securely fastened leash while off the property. Subsection (c) requires humane restraint during transport.

Four further rules sit in the same section. A female dog or cat in heat must be confined behind a solid barrier such as a wooden fence, inside the home, or in a veterinary hospital or animal establishment, and tethering cannot be her only restraint. Invisible fencing needs warning signs on all sides of the yard, and it is barred for animals in estrus, dangerous dogs, and animals that have unjustifiably threatened or bitten a human or another animal. Owners previously convicted of or pleading guilty to the restraint ordinance or similar state law cannot use invisible fencing except at the animal control manager's discretion. In any public park or playground in the parish, the animal needs a securely fastened leash and a firm grasp on it at all times, except in parks designated as dog parks.

Under Sec. 6-27, animal control officers seize any domestic animal found not restrained and off the owner's property, and impounded domestic animals are held for not less than five calendar days. Sec. 6-29(d) charges an impound fee of $5.00 per day, including partial days, on redemption. Under Sec. 6-21, the Sheriff's Office issues the citation at animal control's request, and the owner of an animal running at large has five days from the citation date to pay the impound fee at the shelter.

Violations & Fines

Failure to restrain is the offense under Sec. 6-26(g). A first offense, or any offense more than one year after the last, is fined $15.00 for a vaccinated, spayed or neutered animal, $35.00 for an unvaccinated spayed or neutered animal, or $50.00 for an unvaccinated animal that is not spayed or neutered, plus $5.00 for each additional day of care and feeding. A second offense within one year costs $80.00 or $100.00, a third costs $120.00 or $150.00, and a fourth within one year requires surrendering the animal. Court costs and prosecution expenses are added.

Frequently Asked Questions

Does my dog need a leash in my own yard in unincorporated St. Martin Parish?
Sec. 6-26(b) requires the leash, carrier or vehicle only when the animal is off the owner's or attendant's property. On your own property, Sec. 6-26(a) still requires restraint at all times to prevent escape, and Sec. 6-1 defines restraint as keeping the animal in or on the property. A dog that gets out of the yard has not been restrained.
How much is the fine for a second leash violation within a year?
Sec. 6-26(g)(2) sets $80.00 for a vaccinated or unvaccinated spayed or neutered animal and $100.00 for an animal that is neither vaccinated nor spayed or neutered, and a leash law citation can also be issued. A third offense within one year raises those figures to $120.00 and $150.00, and a fourth requires surrender of the animal.
Do dogs need leashes in parish parks and playgrounds?
Yes. Sec. 6-26(f) makes it unlawful to bring an animal into any public park or playground in the parish without a securely fastened leash and without maintaining a firm grasp on the leash at all times. Parks designated as dog parks are excluded from that rule, so the leash requirement does not apply inside them.
What happens if animal control picks up my loose dog?
Under Sec. 6-27, an officer can seize a domestic animal found unrestrained off the owner's property, and the animal is confined for not less than five calendar days. Redeeming it means paying applicable fees and fines, including $5.00 per day under Sec. 6-29(d). If the dog wears a tag with your name and address, the officer notifies you, and you have five days from receipt to claim it.
