Exotic pets in Delray Beach are governed by the Florida Fish and Wildlife Conservation Commission (FWC) Class I, II, and III permit system. Class I species (big cats, bears, great apes) are prohibited as personal pets statewide.
Under FL Β§379.3761 and Florida Administrative Code 68A-6, the FWC classifies captive wildlife into three tiers. Class I species (tigers, lions, bears, great apes, elephants) cannot be kept as personal pets in Delray Beach or anywhere in Florida. Class II (cougars, wolves, baboons, alligators, macaques) require an FWC permit documenting 1,000 hours of handling experience plus FWC-approved caging inspected on-site. Class III (most reptiles, non-venomous snakes, small mammals like ferrets) generally require only a no-cost FWC license for personal use. Burmese pythons, green anacondas, and 14 other Prohibited reptiles are banned statewide under Rule 68-5.007 (2021) with limited commercial permit exceptions. Delray Beach additionally enforces zoning-based restrictions through Land Development Regulations (LDR) that prohibit commercial menageries in residential districts. Palm Beach County Animal Care and Control provides enforcement backup.
Possession of a Class I species as a pet is a 2nd-degree misdemeanor under FL Β§379.3761, punishable by up to $500 and 60 days in jail per violation. Unpermitted Class II possession can carry $1,000 fines and animal seizure. FWC citations are separate from any local Delray Beach code enforcement action.
