Kennel licenses. Any person who maintains a kennel wherein more than four dogs are kept for show, trial, sale, breeding or other purposes may apply to the County or its duly authorized agents on a form prescribed by the County for a kennel license in lieu of a license for each dog and pay the appropriate fee indicated in Subsection A of this section.

Refusing entry to a dog control agent for such an inspection is unlawful. Chapter 60 regulates dogs only; Sussex County's code does not impose a numeric limit on cats.

Violations & Fines

Keeping more than four dogs without a kennel license, or failing an individual dog license by March 1, draws a $50 fine for a first offense and $100 for a subsequent offense within 12 months, with the subsequent-offense minimum not subject to suspension. If a kennel fails inspection and isn't brought into compliance within the warning period (at least 10 days, extendable up to 60), the county can suspend the kennel license and fine the operator under 7 Del. C. § 1714.
