Summary
Unincorporated Pima County allows wildlife rehabilitation facilities in every zone with no conditional use permit, but Section 18.09.020(M) requires the operator to hold a valid Arizona state license to rehabilitate wildlife and to meet the underlying zone's development standards. Domestic-animal rescue and sanctuary operations, covered separately under subsection N, need a Type I conditional use permit instead.
M. Wildlife Rehabilitation Facilities. 1. Scope: Wildlife rehabilitation facilities are permitted in any zone. 2. Requirements: a. The facility must be operated, maintained, and under the direct supervision of an individual who possesses a valid license from the state of Arizona to operate a wildlife rehabilitation facility or to operate a facility to hold wildlife for purposes of education, scientific or humane treatment when the animal is unable to meet its own needs in the wild. b. Full Breakdown
Pima County's zoning code splits animal-care uses into two very different tracks. 020(M): no conditional use permit or public hearing is required. The only conditions are that the facility be operated and directly supervised by someone who holds a valid Arizona state license to run a wildlife rehabilitation facility, or a license to hold wildlife for education, science or humane treatment when the animal can't fend for itself in the wild, and that the site otherwise comply with the zone's ordinary development standards, meaning setbacks, height, lot coverage and parking.
97 in most residential and rural zones, plus a site plan, hearing administrator review of animal counts, and compliance with Title 6 of the county code. 020(O) makes clear the heavier Section N conditional-use requirements apply only to the domestic and non-wildlife animals on site; animals under the jurisdiction of the Arizona Game and Fish Department stay under the lighter Section M rules. In practice, a Tucson-area resident running a backyard raptor or javelina rehab operation under an Arizona Game and Fish license doesn't need a county hearing to operate, but still has to keep enclosures, fencing and structures within the zone's normal setback and coverage limits, and loses the exemption the moment the property starts keeping rescued dogs or cats without also meeting Section N.
Violations & Fines
Operating a wildlife rehabilitation site without the required state license, or without meeting the zone's development standards, is enforceable as a zoning violation under Section 18.95.040: up to $750 per day for an individual and $10,000 per day for a corporation, with each day of noncompliance a separate offense. The county attorney, zoning inspector, board of supervisors, or a specially-damaged neighbor can also seek an injunction or abatement order to stop the use.
