ADU Owner Occupancy

Within Independence's West Central Overlay District, the lot owner must live in either the main house or the ADU, never rent out both at once, with a six-month annual absence allowance.

Tiny Homes

Independence has no standalone tiny-home zoning; a tiny house is only legal as a West Central Overlay District ADU, capped between 300 and 900 square feet and built to the IRC Tiny House appendix.

Constructing a tiny house/ADU that doesn't meet the adopted IRC Tiny House appendix, or that falls outside the 300-900 square-foot size band without special use approval, can draw a stop-work order and code enforcement citation from the Building Safety Division.

ADU Rental Restrictions

ADUs in Independence's West Central Overlay District can't be rented for under 30 days unless approved as a bed and breakfast, and any non-owner-occupied ADU falls under the city's Rental Ready program.

Key details: Minimum rental term: 30 consecutive days. Short-stay exception: Approved B&B only, Β§ 14-420. Non-owner ADUs: Must join Rental Ready Program. Scope: West Central Overlay District only.

Renting an ADU for stretches under 30 days without bed-and-breakfast approval is a zoning code violation subject to citation; operating a non-owner-occupied ADU without Rental Ready registration is a separate Chapter 4 violation enforceable by the City.

Compared to other cities, Independence takes a harder line on adu rental restrictions. The enforcement and penalty structure reflects that.

Shed & Carport Rules

Independence requires a 5-foot interior setback for detached accessory buildings and sheds in most residential districts, caps their height at 25 feet, and exempts only sheds of 120 square feet or less from a building permit.

Key details: Interior setback (most R districts): 5 feet. Interior setback (R-A district): 35 feet. Max height: 25 ft or principal bldg height. Rear-yard coverage cap: 15% (or 600 sq ft min). Permit-exempt size: 120 sq ft, one-story.
