Building Safety in Doral, FL: What Residents Actually Need to Know

By CityRuleLookup Editorial Team

If you live in Doral or are thinking about moving there, building safety are one of those things you probably won't think about until they affect you directly. Doral has 4 specific rules on the books covering different aspects of building safety, and some of them might surprise you.

Building Permits

In Doral, no development activity can begin without a development permit backed by a development order under Land Development Code Sec. 53-183. The city carves out nine specific exceptions, covering single-family and townhouse construction, accessory structures on developed lots, demolition, fences and signs on already-developed sites, tree clearing, farm structures, resurfacing, and certain antennas, where a building permit alone is enough.

Key details: Baseline rule: Development permit needs a development order first. Exceptions: 9 listed activities need only a building permit. Fee authority: Set by council resolution, capped at actual cost. Administrator: Administrative official appointed by city manager. Enforcement: Notice, correction period, then special magistrate referral.

Sec. 53-235 lets the city enforce the Land Development Code's Sec. 53-183 permit and development order requirements by any lawful method. When staff believes a provision is being violated, the department notifies the violator and sets a reasonable correction period under code enforcement division policy. If not corrected in time, the case is referred to the special magistrate for enforcement under article II of chapter 56, which can impose fines.

Childcare Center Rules

Doral requires licensed child care facilities to meet zoning-district rules under Section 74-342 plus outdoor-area and floor-area standards under Section 74-343. The outdoor play area counts toward the site's required open space only if the site plan shows direct or protected access to it, adequate safety provisions, and integration with the site's other uses.

Key details: Governing section: Doral Code of Ordinances Β§ 74-343. Open space credit: Requires site plan showing safe outdoor access. Floor-area bonus: 3 extra sq ft per child-care sq ft. Approval authority: Director of planning and zoning department. Recorded covenant: Required to restrict space to child care use.

A licensed child care facility that claims the open-space credit or the three-to-one floor-area bonus in Section 74-343 without the required plot use or site plan showing safe, integrated access to the outdoor area, or without the recorded covenant restricting that space to child care use, is out of compliance and can lose the credit or bonus through the planning and zoning department's review.

Building Inspections

Doral inspects construction under Sec. 53-420 against chapter 8 of the Miami-Dade County Code, giving the city authority to reject materials or suspend work, and scheduling the final inspection within five working days of a complete request before any certificate of occupancy can issue.

Key details: Final inspection scheduling: Within 5 working days of request. Reinspection scheduling: Within 3 working days. Improvement warranty: 10 percent of construction cost. Construction guarantee: 110 percent of uncompleted improvement cost. Cross-referenced code: Miami-Dade County Code chapter 8.

Occupying or using a building before the city accepts site improvements and issues the certificate of occupancy under Sec. 53-420(b) is a Land Development Code violation; construction found out of conformance with the development permit can be rejected or halted mid-project by city inspectors, and a developer who ignores a stop-work order faces code enforcement citation before the special magistrate in addition to withheld inspection sign-off.

Green Building Code

Doral's green building chapter applies mandatory certification to any new building, reconstruction or land development project of 25,000 square feet or more, offering incentives of $300 per home, $1,000 per non-residential or multifamily building, and $2,500 per land development project once the building official confirms compliance.

Key details: Mandatory size threshold: 25,000 sq ft interior space. Home incentive: $300.00 per home. Building incentive: $1,000.00 per building. Development project incentive: $2,500.00 per project. Green Building Bond: 2 percent of construction cost.

A project that meets the 25,000-square-foot threshold in Sec. 63-2 but fails to pursue the required certification is denied the green building permit track and cannot claim the Sec. 63-6 fee incentives; a project that already claimed incentives and posted a Green Building Bond forfeits the full two percent bond to the city if it cannot document certification within 24 months of the certificate of occupancy under Sec. 63-7.

The Bottom Line

Doral's building safety rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Doral is broadly strict or permissive.

Keep in mind that Doral can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
