Building Safety in Modesto, CA: What Residents Actually Need to Know

Building Inspections
Modesto's Building Official runs a fixed sequence of inspections, footing and foundation, concrete slab, frame and masonry, energy efficiency, and final, before work can be covered or occupied. Owners must keep work visible for each inspection or pay a reinspection fee when work is called before it is ready.

Covering foundation, framing, or other required-inspection work before it is approved, or failing to provide access on a scheduled inspection date, exposes the permit holder to reinspection fees under Section 9-1.815 and can require exposing the concealed work again at the owner's expense. Occupying or using a structure before final inspection and approval under Section 9-1.814 violates the Building Code.
Elevator Maintenance
Modesto requires every elevator, escalator and dumbwaiter to be maintained under national ASME A17.1 standards, with a current inspection certificate posted for public view and at least one elevator kept running whenever a building with passenger elevators is occupied.

Electrical Permits
Modesto adopts the 2022 California Electrical Code by reference under Code of Ordinances § 9-3.101, and § 9-3.501 requires a permit before any electrical installation, alteration, or repair regulated by that Code. The Building Safety Division, under the Community and Economic Development Department, reviews applications and inspects the work.

Section 9-3.1118 makes any violation of the Electrical Code a misdemeanor, punishable by a fine of not more than $1,000, up to six months in county jail, or both; the City Attorney may instead charge it as an infraction, punishable by a fine not exceeding $250 for a first conviction and not exceeding $500 for a second or later conviction within one year. Each day a violation continues is a separate offense. Section 9-3.1119 also allows administrative penalties under Title 1, Chapter 6 of the Municipal Code as an added remedy.
Plumbing Permits
Modesto adopts the 2022 California Plumbing Code by reference under Code of Ordinances § 9-2.101, and § 9-2.501 requires a permit before any plumbing or drainage installation, alteration, or repair regulated by that Code. The Building Safety Division reviews applications and inspects the work under the Building Official's authority.

Section 9-2.1118 makes any violation of the Plumbing Code a misdemeanor, punishable by a fine of not more than $1,000, up to six months in county jail, or both; the City Attorney may instead prosecute it as an infraction, carrying a fine of not more than $250 for a first conviction and not more than $500 for a second or later conviction within a year. Each day a violation continues counts as a separate offense. Section 9-2.1119 adds administrative penalties under Title 1, Chapter 6 of the Municipal Code.
Childcare Center Rules
A child day care center run out of a commercial building, not a home, is a conditional use in Modesto's residential and professional-office zones but a permitted use outright in the mixed-use, commercial and industrial zones. Parking for commercial child day care is set at one space per five children.

Opening or operating a commercial child day care center in a residential or professional office zone without first obtaining the required conditional use permit is a Code violation. Section 1-2.01 makes most Code violations a misdemeanor, punishable by up to a $1,000 fine and one year in the Stanislaus County Jail, or an infraction at the City Attorney's election, carrying a fine of up to $500 per offense, with each day of continuing violation charged separately.
Fire Sprinkler Requirements
Modesto's Fire Code amendment requires an automatic fire sprinkler system in any new building or structure where the fire area exceeds 5,000 square feet, regardless of use or occupancy. Condominiums and apartment buildings up to four stories can meet this with an NFPA 13R system and full attic protection instead of full NFPA 13 coverage. The rule took effect January 8, 2026 under Ordinance No. 3802-C.S.

Because Section 903 is adopted into the Municipal Code, a violation defaults to the citywide penalty in Section 1-2.01: a misdemeanor punishable by up to $1,000 and up to one year in county jail, or an infraction up to $500, at the City Attorney's election, with each day of noncompliance treated as a separate offense.
Green Building Code
Modesto enforces the 2022 California Green Building Standards Code (CALGreen), Title 24 Part 11, for both residential and nonresidential construction. The Building Safety Division administers energy efficiency, water efficiency, and material conservation requirements on every covered permit citywide.

Work performed without the required CALGreen compliance documentation is treated as a Building Code violation.
