Oak Park's Building Safety: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles building safety a little differently. In Oak Park, Illinois, there are 9 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Elevator Maintenance

Oak Park's Residential Tenant and Landlord Ordinance gives every tenant the right to a dwelling that materially complies with habitability standards, which specifically require elevators to be kept structurally sound, in good condition, and maintained in good repair.

Key details: Governing article: Ch 12, Art 6, Residential Tenant and Landlord Ordinance. Standard: Elevators sound, good condition, good repair. Reference code: 2009 International Property Maintenance Code. Tenant remedy: Damages and injunctive relief, Sec 12-6-6(C). Penalty: $20-$750 per offense, per day.

A landlord who lets a required elevator fall out of sound condition or good repair faces tenant civil remedies under Section 12-6-6(C), damages and injunctive relief, plus a Village fine of $20.00 to $750.00 per Section 1-1-5, applied through Section 12-6-16, with each day of noncompliance a separate offense.

Door Locking Hardware

Oak Park's rental habitability standard requires every dwelling unit's windows, exterior doors, and basement hatchways to be substantially tight and fitted with locks or security devices, including dead latch locks, deadbolt locks, sash locks, and peepholes.

Key details: Governing article: Ch 12, Art 6, Residential Tenant and Landlord Ordinance. Required hardware: Dead latch, deadbolt, sash/ventilation locks, peepholes. Covers: Windows, exterior doors, basement hatchways. Minor-repair cap: $500.00 or one half month's rent. Penalty: $20-$750 per offense, per day.

A landlord who fails to provide or repair required deadbolts, sash locks, or door hardware faces tenant remedies under Section 12-6-6 (damages, injunctive relief, or a self-help repair-and-deduct up to $500.00 or one half month's rent) plus a Village fine of $20.00 to $750.00 under Sections 12-6-16 and 1-1-5, with each day a separate offense.

Lead Paint

Oak Park landlords must give every prospective and current tenant the EPA lead-based paint pamphlet and disclose any known lead hazards, and a tenant can recover one month's rent or actual damages plus attorney's fees if the landlord fails to comply.

Key details: Required disclosure: EPA lead-based paint pamphlet, all tenants. Known hazards: Must be disclosed to tenant. Tenant remedy: 1 month's rent or actual damages plus fees. Governing article: Ch 12, Art 6, Residential Tenant and Landlord Ordinance. Adopting ordinance: Ord. 21-60, 7-19-2021.

A landlord who fails to provide the EPA lead pamphlet or disclose a known lead hazard, after receiving written notice of the failure, is liable to the tenant for one month's rent or actual damages, whichever is greater, plus reasonable attorney's fees, under Section 12-6-10(E)(2), separate from any federal lead-disclosure penalty.

Scaffold & Sidewalk Shed

Village Code § 7-1-2 modifies the adopted building code's pedestrian protection table so that any construction site more than 8 feet tall and within 10 feet of the lot line must run a system of scaffolding and netting over the full work area, not just a basic barrier or covered walkway.

Key details: Trigger: Construction over 8 feet, within 10 feet of lot line. Required protection: Scaffolding and netting over full work area. Excavation barrier: 6 feet high if within 5 feet of street lot line. Site fence: 8-foot chain link, opaque fabric, gates every 50 feet. Prohibited materials: Barbed wire or razor wire fencing.

Failing to erect the required scaffolding, netting, or site barrier is enforced as a building code violation. Absent a more specific penalty, Village Code § 1-1-5 applies a fine of $20 to $750, with each day of noncompliance treated as a separate offense, and the building official may also order the work stopped until protection is in place.

Building Permits

Oak Park requires a permit from the building official before anyone constructs, enlarges, alters, repairs, moves, or demolishes a building, changes its occupancy, or installs, alters, or replaces electrical, gas, mechanical, or plumbing systems, including adding attic insulation. The rule is set out in the Village's own amendments to the adopted 2021 International Building Code, and unpermitted work is an unlawful act subject to administrative penalties.

Key details: Permit required for: Construction, alteration, demolition, occupancy change, system work. Issuing office: Chief Building Official, Permitting and Development Division. Base code: 2021 International Building Code, as amended. Unpermitted work: Declared illegal, subject to administrative penalties. After-the-fact rule: Sworn statement required under § 105.1.3.

Working without a required permit is expressly declared illegal and an unlawful act under § 7-1-2 (amended Section 105.1), triggering administrative penalties under the building code plus any fine set elsewhere in the Village Code. A contractor or owner who starts work first must also file a sworn statement under § 105.1.3 describing the work, dates, and costs before the Village will bring the project into compliance.

Carbon Monoxide Detectors

Oak Park requires every licensed bed and breakfast to install carbon monoxide detectors on each level of the building, including the basement and any habitable attic space the owner uses, before the Village will issue or renew its business license. Village Code Section 8-32-4(H)(11) ties the standard to the residential building code the Village has adopted.

Key details: Governing section: Village Code § 8-32-4(H)(11). Use covered: Licensed bed and breakfast establishments. Coverage: Every level incl. basement and habitable attic. Standard referenced: Adopted residential building code. Trigger: Required for annual license issuance/renewal.

A bed and breakfast that lacks the required carbon monoxide detectors fails its Fire Department inspection and cannot obtain or renew its license under Section 8-32-3. Operating a bed and breakfast without a current license, or after renewal has been denied for noncompliance, exposes the owner to Oak Park's general penalty in Village Code Section 1-1-5, a fine between $20.00 and $750.00, with each day of continued operation charged as a separate offense.

Plumbing Permits

The Village of Oak Park has no separate municipal plumbing code: it adopts the current edition of the State of Illinois Plumbing Code by reference, adds a local WaterSense fixture mandate, and keeps three copies on file for public inspection with the Village Clerk.

Key details: Adopted code: Current State of Illinois Plumbing Code. Local fixture rule: WaterSense label required on new/replacement fixtures. Public copies: 3 kept on file with Village Clerk. Adopting ordinance: Ord. 15-179, 11-16-2015. General penalty: $20-$750 per offense, per day.

Plumbing work performed in violation of the adopted State of Illinois Plumbing Code, including installing non-WaterSense fixtures, exposes the installer or property owner to the Village's general code penalty under Section 1-1-5: a fine of not less than $20.00 nor more than $750.00, with each day of a continuing violation a separate offense.

Electrical Permits

The Village of Oak Park adopts the National Electrical Code by reference for all electrical work, keeps copies on file with the Chief Building Official, and layers on local amendments such as a mandatory outdoor garage receptacle and grounded ceiling-fan boxes.

Key details: Adopted code: 2021 National Electrical Code, by reference. Local rule: 1 outdoor garage receptacle, max 5.5 ft above grade. Local rule: Ceiling boxes near center must support paddle fans. Public copies: 3 kept with Chief Building Official. Latest amendment: Ord. 23-49 and Ord. 23-55, 6-20-2023.

Electrical work performed without a permit or that fails to meet the adopted National Electrical Code as locally amended, including the required outdoor garage receptacle and ceiling-fan-rated outlet boxes, is enforced through the Village's building inspection process and is punishable under the general code penalty in Section 1-1-5: a fine of $20.00 to $750.00 per offense, each day a separate offense.

Fire Sprinkler Requirements

Village Code § 7-6-2 amends the adopted residential code to require an automatic residential fire sprinkler system in every new one- and two-family dwelling built in Oak Park, though additions and alterations to existing homes without a system already installed are exempt.

Key details: Who must comply: New one- and two-family dwellings. System required: Automatic residential fire sprinkler system. Exception: Additions/alterations without existing system. Existing structures: Governed separately by appendix § AJ101.9. General fine range: $20 to $750 per day, § 1-1-5.

Constructing a new one- or two-family dwelling without the required automatic fire sprinkler system is a residential code violation subject to the general penalty of Village Code § 1-1-5: a fine of $20 to $750, with each day of noncompliance treated as a separate offense, in addition to any permit or occupancy delays imposed by the building official pending correction.

Compared to other cities, Oak Park takes a harder line on fire sprinkler requirements. The enforcement and penalty structure reflects that.

The Bottom Line

Oak Park's building safety rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Oak Park is broadly strict or permissive.

These rules come from Oak Park's publicly available municipal code. For complete penalty schedules, exemption details, and answers to common questions, see the individual ordinance pages throughout this guide.
