Pottstown's Building Safety: The Rules That Matter

Building Inspections

Occupying a dwelling, rental unit or commercial building before the required certificate issues is itself a violation the Code Enforcement Officer can act on, separate from any underlying property-condition citation.

Plumbing Permits

Pottstown adopted the 2009 International Plumbing Code as its Plumbing Code under Section 401 of Chapter 5, Part 4, and every plumbing installation, alteration or repair needs a permit under that code. The Borough's own amendments set the frost depth at 36 inches and back the code with fines up to $1,000, and only a Borough-registered master or journeyman plumber may pull the permit.

Nonpayment of a penalty can add up to 30 days imprisonment, and the underlying code violation itself is a summary offense under the amended Section 108.4, fined up to $1,000 with up to 30 days.

Electrical Permits

Pottstown adopted the ICC Electrical Code, Administrative Provisions, as its Electrical Code under Section 501 of Chapter 5, Part 5, so every electrical installation, alteration or repair inside the Borough needs a permit under that code. Section 502 swaps in the Borough's own name and its Fee Resolution for the model code's fee sections, and permit fees are set by Borough Council resolution rather than printed in the code.

Unlike the Plumbing, Mechanical and Fuel Gas Codes in the neighboring Parts of this chapter, the Borough left the ICC Electrical Code's own penalty and violation sections unamended in Section 502, so an unpermitted or noncompliant electrical installation is enforced under the penalty provisions printed in the adopted 2003 ICC Electrical Code itself, through the Licensing and Inspections Department, rather than under a Pottstown-specific fine schedule.

Building Permits

Pottstown requires a zoning permit before you build or install any structure, including signs, fences and storage buildings, before you change the use of land or a building, or before installing solar equipment over eight square feet, under Section 200 of the Zoning Ordinance. Construction itself also runs through the Pennsylvania Uniform Construction Code, which the Borough elected to administer and enforce under Sections 901 and 902 of Chapter 5.

Building or changing a use without the zoning permit Section 200 requires exposes the responsible party to a civil enforcement proceeding under Section 1105, capped at a $500 judgment plus court costs and the Borough's reasonable attorney fees, with each day the violation continues after that ruling counted as a separate violation. On the construction side, work done without the required Uniform Construction Code permit is enforced through the code official the Borough designates under Section 903.

Carbon Monoxide Detectors

Pottstown's Fire Code amendment, Section 603.4.2, requires a permit before installing any unvented, gas-fired space heater and mandates a carbon monoxide detector mounted near the unit. The heater must also carry an oxygen depletion sensor that shuts it down automatically if oxygen levels drop, and its gas line must be color-coded yellow.

Installing an unvented gas-fired heater without a permit, without an ODS shutoff, or without the required carbon monoxide detector is a Fire Code violation. Since Part 2 sets no separate fine, Chapter 1, § 215 governs: $50 to $1,000 plus prosecution costs, up to 30 days in default of payment, and each day uncorrected counts as a new offense.

Green Building Code

Pottstown Borough Council adopted the 2009 International Energy Conservation Code by reference under Borough Code §§ 1101-1102, governing energy-efficient building envelopes and mechanical, lighting and power systems in new construction and renovation. The Borough's own amendment rewrites the penalty clause, inserting local fine figures of $50 and $1,000, and routes permits and fees through the Licensing and Inspections Director.

Chapter 5's general code-enforcement provisions apply for notices of violation, and the Licensing and Inspections Director's office handles plan review, inspections and permit fees set by Borough Council resolution under § 906.
