Albany's Building Setbacks & Zoning: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles building setbacks & zoning a little differently. In Albany, New York, there are 3 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Setback Rules

Albany's Unified Sustainable Development Ordinance sets minimum front, side, and rear yard setbacks by zoning district, from a 0-foot front yard in the R-T District to 25 feet in R-1L.

Key details: R-1L front yard minimum: 25 feet. R-T front yard minimum: 0 feet. R-1L rear yard minimum: 40 feet. Accessory structure side/rear setback: 2 feet (except R-T). Governing table: USDO Table 375.401.1 / .2.

Building without conforming setbacks blocks development plan approval, and no building permit or certificate of occupancy may be issued until the plan meets Table 375.401.1 or 375.401.2's minimums.

Lot Coverage Limits

Albany limits how much of every lot can be covered by buildings, driveways, and other impervious surfaces, with maximum coverage ranging from 30% to 80% by zoning district, to curb stormwater flooding and combined sewer overflows.

Key details: R-1L max coverage: 30% impervious. R-1M max coverage: 40% impervious. R-2 max coverage: 70% impervious. R-T / R-M max coverage: 80% impervious. R-V max coverage: 50% impervious.

No development plan may be approved and no building permit may be issued for a project that fails to meet Β§ 375-401's dimensional standards, including the maximum impervious coverage limits, so exceeding the cap blocks permit issuance outright.

Structure Height Limits

Albany caps principal residential buildings at 35 feet (2.5 stories) in the R-1L, R-1M and R-2 districts, rising to 45 feet in R-T, 55 feet in R-M and 65 feet in R-V, under the Unified Sustainable Development Ordinance's dimensional standards table.

Key details: R-1L / R-1M / R-2 max: 35 feet, 2.5 stories. R-T max: 45 feet, 3.5 stories. R-M max: 55 feet, 4 stories. R-V max: 65 feet, 5 stories. Accessory structure max: 16 feet, 1.5 stories.

A structure built above the table's story or foot limit cannot obtain a building permit; the City's Department of Buildings and Regulatory Compliance enforces the USDO's dimensional standards and can require the noncompliant portion reduced or removed as a code violation.

The Bottom Line

Albany's building setbacks & zoning rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Albany is broadly strict or permissive.
