Portland's Building Setbacks & Zoning: The Rules That Matter

Every city handles building setbacks & zoning a little differently. In Portland, Maine, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Setback Rules

Portland's Land Use Code fixes front, rear and side setback minimums zone-by-zone in Table 7-A of Article 7, not as one citywide number. In the RN-1 Residential Neighborhood zone the minimum front setback is 20 feet, or the average of adjacent front yards minus 5 feet, whichever applies to the lot.

Land Use Code § 1.5.1 makes any violation of the setback tables a chargeable offense: the owner, occupant, or person in control of the building or lot "shall be guilty of an offense and subject to the penalties and remedies provided in Chapter 1, Section 1-15 of the City of Portland Code of Ordinances and 30-A M.R.S. § 4452." The City's Building Authority and Code Enforcement Officer bring the action, through Corporation Counsel if needed.

Structure Height Limits

Portland's Land Use Code caps residential structure height at 35 feet across the RN-1, RN-2, RN-3, and (as a base figure) RN-4 zones, drops to 18 feet in the low-density RN-5 zone, and allows up to 65 feet in the denser RN-6 zone. The City of Portland Height Map or Fort Sumner Park Height Overlay can override these Table 7-A baselines.

Building or altering a structure above these Table 7-A limits without approval is a Land Use Code violation under § 1.5.2: the owner, occupant, or person in control is guilty of an offense subject to the penalties in Code of Ordinances § 1-15, a fine of $100 to $500 for each offense, with every day the violation continues counted as a separate offense, plus the remedies available under 30-A M.R.S. § 4452, including court action to remove or alter noncompliant construction.
