Building Setbacks & Zoning in Rothschild, WI: What Residents Actually Need to Know

By CityRuleLookup Editorial Team

If you live in Rothschild or are thinking about moving there, building setbacks & zoning are one of those things you probably won't think about until they affect you directly. Rothschild has 2 specific rules on the books covering different aspects of building setbacks & zoning, and some of them might surprise you.

Setback Rules

Rothschild requires every building or accessory structure, including sheds, parking structures, and fences, to sit at least 75 feet back from the ordinary high-water mark of the Wisconsin River or any other waterway in the Village. Zone-by-zone front, side and rear yard tables in Article II of the zoning chapter set further minimums for each residential and commercial district.

Key details: Waterfront setback: 75 ft from ordinary high-water mark. Applies to: Buildings, sheds, parking structures, fences. Mobile homes: Prohibited on any lot. District tables: Separate front/side/rear minimums, Article II. Penalty: $100 to $1,000 forfeiture, § 590-181.

A structure built inside the 75-foot waterfront setback, or any other zoning setback violation, is enforced under the Zoning Chapter's general penalty, § 590-181: a forfeiture of $100 to $1,000 plus costs, assessments, surcharges and fees, with every day the violation continues counted as a separate offense. Every zoning violation is also declared a public nuisance, letting the Village seek an injunction to force compliance.

Structure Height Limits

Primary buildings in Rothschild's residential zoning districts cannot exceed 35 feet in above-grade height once erected or structurally altered. The same 35-foot cap repeats word for word in the bulk-limitations subsection of every residential district, so it functions as the Village's standard house height ceiling regardless of which residential zone a lot sits in.

Key details: Height cap: 35 ft above grade, primary buildings. Applies to: All Rothschild residential districts, R-1 to R-R. Accessory buildings: Separate limits under § 590-96.1. Lot coverage: 50% max, same subsection. Penalty: $100 to $1,000 forfeiture, § 590-181.

Exceeding the 35-foot residential height cap is a zoning violation enforced under § 590-181: a forfeiture of $100 to $1,000 plus applicable costs, assessments, surcharges and fees, with each day the violation continues treated as a separate offense. The Code declares every zoning violation a public nuisance, so the Village can also go to court for an injunction ordering a noncompliant structure altered or removed.

The Bottom Line

Rothschild's building setbacks & zoning rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Rothschild is broadly strict or permissive.

Keep in mind that Rothschild can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
