Goodyear's Business Licensing & Operations: The Rules That Matter

Auto Repair on Residential Property

Goodyear's home occupation rules flatly exclude on-site vehicle repair from qualifying as a home-based business. Running a repair shop out of a residential garage isn't a permitted home occupation no matter how small the operation, so it needs a licensed commercial or industrial location instead.

Key details: Excluded use: on-site vehicle repair as a commercial use. Also excluded: nonresident employees, commercial storage, hotels/motels. Required instead: commercial/industrial zoned location + license. First unlicensed-business fine: $300 minimum. Governing section: Goodyear City Code § 8-7-1.

Because on-site vehicle repair can never qualify as a home occupation, running one from a residence is treated as an unlicensed or improperly located business. Section 8-7-9(C) sets a $300 minimum fine for a first violation of operating without a license and a mandatory $1,000 to $2,500 fine for a second or later violation, and the City can also pursue zoning-based enforcement for the improper use.

Compared to other cities, Goodyear takes a harder line on auto repair on residential property. The enforcement and penalty structure reflects that.

Tattoo & Body Modification

Goodyear treats tattoo parlors and body piercing studios as regulated uses that need Zoning Administrator sign-off and a Zoning Permit before opening. A proposed studio cannot sit within 1,000 feet of another tattoo or piercing studio, an adult business, or a school, though two studios may share the same building.

Key details: Approval required: Zoning Administrator approval + Zoning Permit. Separation from other studios: 1,000 feet. Separation from adult businesses: 1,000 feet. Separation from schools: 1,000 feet. Same-building exception: Tattoo and piercing studios may co-locate.

Opening a tattoo or piercing studio without an approved Zoning Permit, or inside the 1,000-foot buffer from another studio, an adult business, or a school, violates Zoning Ordinance Article 7. The City can impose a civil sanction of $100 to $1,000 per offense or charge a class 1 misdemeanor carrying up to a $2,500 fine, six months in jail, and three years of probation, with each day of the violation counted separately.

Adult Entertainment

Goodyear's Zoning Ordinance keeps adult bookstores, adult theaters, live-entertainment establishments and erotic dance studios at least 1,000 feet from each other and 500 feet from schools, churches, parks and listed residential zoning districts, with no variances allowed from these standards.

Key details: Same-use separation: 1,000 feet. School/church/park buffer: 500 feet. Residential district buffer: 500 feet. Variances allowed: None permitted. Nonconforming expansion: Prohibited.

Adult uses that already violate the 1,000-foot same-use or 500-foot sensitive-use spacing are grandfathered as nonconforming, but Section 3.11.1(A)(2) locks them in place: they cannot convert to any other listed adult use type and cannot expand beyond the floor area occupied on the ordinance's effective date. Section 3.11.1(A)(3) also removes the Zoning Administrator's and Planning Commission's authority to grant variances from these standards.

This is not one of those rules that cities tend to ignore. Goodyear actively enforces its adult entertainment requirements.
