Lakewood's Business Licensing & Operations: The Rules That Matter

Anyone buying secondhand goods, jewelry or precious metals for resale in Lakewood Township needs a Municipal Clerk license under Code § 4-9. Dealers must print their license number on every ad, in at least 8-point type, and photograph each seller and item.

Each violation is treated separately, and a repeat violation within one year adds a further fine.

Towing Companies

Lakewood Township requires a Police Department-vetted towing license before any wrecker operator can work police-called or non-consent tows. Code § 4-6 sets equipment standards, a posted rate schedule, a 15-minute response benchmark, and a graduated suspension schedule for violations.

The Chief of Police can suspend a wrecker's license for safety or rules violations on a graduated schedule: a first offense draws a one-week suspension, a second offense a two-week suspension, and a third offense triggers revocation pending a Township Committee hearing (§ 4-6.8y). The Township Committee can independently suspend or revoke any license for good cause after written complaint and a hearing (§ 4-6.9).

Massage Establishments

Lakewood Township requires a separate Township Clerk permit for every massage business and for each masseur or masseuse, backed by a $100 filing fee, a 70-hour training requirement, and a flat ban on touching a patron's sexual or genital area.

Any violation of § 4-7's requirements, or engaging in prohibited touching, is unlawful and constitutes grounds for revocation of the permit under § 4-7.25. A permit may also be revoked or suspended after a hearing for sanitation failures reported by the Director of Public Health (§ 4-7.14), and refusing to allow a Police Officer or Health Inspector to inspect the premises is itself unlawful (§ 4-7.22).

Pawnbrokers

Lakewood Township licenses pawnbrokers, defined as anyone lending money on a pledge of personal property, under Code § 4-9. Operators post a $10,000 bond, pay a $400 license fee, and must hold every pledged item at least 10 business days before disposing of it.

A third violation, or a second within one year of an earlier one, is grounds for revocation (§ 4-9.6g1), and a repeat offender within a year of a prior fine faces an additional fine.

Auto Repair on Residential Property

Lakewood Township, Ocean County, does not allow automobile repair or service businesses as a home occupation. The Unified Development Ordinance lists Automobile Repair Services as a conditional use in the Industrial (M-1) zone only, so a residential garage cannot legally operate as a repair shop.

A resident who wants to run a repair operation must instead locate on M-1 industrial land and obtain a conditional use permit from the Zoning Board of Adjustment.
